A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA-
HEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CON-
TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE
FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS
AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL
WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW-
ING PUBLIC IMPROVEMENT: CONSTRUCTION. INSTALLATION
AND COMPLET ION OF AN UNDERGROUND r HE INFORCED
CONCRETE VAULT AT THE SOUTHWEST CORNER OF PLACENTIA.

WHEREAS, the City Council of the City of Anaheim did cause t.o
be published in a newspaper of general circulation, printed, published
and circulated in the City of Anaheim, to wit: The Anaheim Gazette
on the 8th and 15th days of October. 1959 ~
a notice inviting sealed proposals for furnishing the following:
All plant, labor, services, materials and equipment, and
all utilities and transportation, including power, fuel
and water, and performing all worK necessary to construct
and complete in a good and workmanlike manner, in strict
accordance with the specifications, plans and drawings
therefor on file in the office of the City Engineer or
City Clerk of the City of Anaheim, the following public
improvement, to wit: Construction, installation and com-
pletion of an underground, reinforced concrete vault for
the installation of lighting and power, for the park
development at the southwest corner of Placentia Avenue
and Vermont Street, in the City of Anaheim, together with
all appurtenant work as indicated on the plans and speci-
fications, Job No. 436,
in accordance with the design, plans, profiles and specifications of
said public improvement on file in the office of the City Clerk of the
City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said public
improvement did provide that sealed proposals would be received by the.
City of Anaheim at the office of the City Clerk of the City of Anaheim
up to the hour of ?nn o'clock P.M. on the 22nd day of Octoher
19~, for the furnishing of all plant, labor, services, materials,
and equipment, all utilities and transportation, including power, fuel
and water, and performing all work necessary to constru.ct and complete
in a good and workmanlike manner, the public improvement hereinabove
more particularly mentioned and described, and which notice did state
and declare that pursuant to the provisions of Section 1770 of the
Labor Code, the City Coun~il of the City of Anaheim bad ascer.t.ained
the prevailing rate of wages in the locality in which this type of
labor is to be performed for each craft or type of workman or mechanic
needed to execute the contract and did set forth the prevailing hourly
wage scale so ascertained; and
WHEREAS, the City Clerk of the City of Anaheim did receive
the following sealed proposals prior to 2: 00 0 t clock P.M. on the
22nd day of October , 19~, in response to the notice
aforesaid inviting sealed proposals, to wit:

late said sealed proposals and did report to the CitvCouncil the re-
sult of his examination.and tabulation; and

shauld be accepted and a cantract awarded ta said bidder in accordance
therewith; and
WHEREAS, the City Cauncil finds that the above mentioned sealed
prapasal is the lawest respansible prapasal received and that the per-
stm, firm .or carporatian submitting said proposal is a responsible
persan, firm .or carparatian and that the prapasal submitted is the
best suited and fitted far the public impravement ta be constructed.
NOW, TFfEREFORE, BE IT RESOLVED by the City Cauncil of the City
.of Anaheim, that the sealed proposal submitted by FRTCKE-RARRTNGTON
CONSTRUCTION. ~~OO E. Colorado Street, Pasadena, r.~1 iforni~
for the furnishing of all plant, labor, services.. materials and equip_
ment, all utilities and transportatian, including p,ower, fuel and water,
and perfarming all wark necessary ta canstruct and cample~e, in a gaod
and warkmanlike manner, in strict accardance with the specifications,
plans and drawings therefar an file in the .office .of the City Clerk .of
the City .of Anaheim and the natice inviting sealed proposals, the pub-
lic warks and impravement hereinabave mare particularly mentioned and
described, tagether with the appurtenances thereta, be, and the same
is hereby, accepted, and that a cantract far the constructian ,and com-
pletian of said public impravemenj;; be, and the Bame.is hereby, awarded
ta the saidabave named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder .or bidders
upon each cantract awarded as hereinaQ~we set forth, shall be, and they
are hereby required ta execute a cantr~ct in the required form with the
City of Anaheim upan the .terms and canditians specified in the natice
inviting sealed prapasals and the prapasal submitted by said success-
ful bidder .or bidders and in accardance with the plans and specifica-
tians far said public impravement hereinabave described, and in accard-

ance with the terms, conditions and provisions of this resalutio~,
and that said successful bidder or bidders to whom each contract is
_ awarded shall be required to furnish a surety bond in an amount equal
to one hundred per cent (100%) of the contract price for~ all Lihor,
materials and equipment to be furnished and performed.,. as s.e..t forth
in the sealed proposal submitted by said bidder for the construction
of said public improvement, together with the appurtenan.ces there;t~
or such portion thereof as is covered by said contract,. as E~curity
for the faithful performance of said contract and a separate sUrety
bond in an amount equal to one hundred per cent (100%) of the con-
struction cost of said public improvement covered by said 'contract,
as security for the payment of all persons performing labor.and fur-
nishing material for said projecto
AWD BE IT FURTHER RESOLVED that said successful bidder Or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the City of Anaheim,' .public lia-
bility, property damage, compensation, and other insurance" in the
amounts and for the purposes as set forth and specified in the notice
inviting sealed proposals, and subject to the approval .of the City
Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the. City Clerk
of the City of Anaheim be, and they are hereby~ authorized. and .
directed to make, execute and enter into, for and on behalf'. of the.
Cl ty of Anaheim, a written.. c.ontract with said succ.esHful bidder or
bldders for the furnishing of all plant, labor, materials, and equip-
ment and performing all work, as hereinabove more particularly des-
cribed, for the construction, installation and completion of said
public improvement hereinabove described upon the terms and conditions
