RESOLUTION NO. 86R-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING EATON WAY EXTENDING NORTHERLY
FROM TAFT AVENUE. (85-lA)
WHEREAS, the City Council of the City of Anaheim did, by
resolution duly adopted, declare its intention to vacate certain
public streets, highways or public service easements pursuant to the
Public Streets, Highways and Service Easements Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law; and
WHEREAS, on the 18th day of February, 1986, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not reserved
and excepted by this resolution, the City Council hereby determines
that the public convenience and necessity requires that no easements
be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Anaheim does hereby order the vacation of Eaton Way extending
northerly from Taft Avenue, more specifically described in Exhibit A
attached hereto and incorporated herein as though set forth in full.
BE IT FURTHER RESOLVED that the vacation authorized by this
resolution shall not be effective until a certified copy of this
resolution is recorded in the Office of the Recorder of Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby, authorized and directed to cause a certified copy of this
resolution to be recorded in the Office of the Recorder of the County
of Orange.

EXHIBIT A
Those easements for road and public utility purposes located in
the City of Anaheim, County of Orange, State of California,
described as follows:
Parcell: A right of way for road purposes over the West
20.00 feet,of a portion of Lot 9 of the Fletcher Tract, as
shown on a Map recorded in Book 3, page 320 of Miscellaneous
Records of Los Angeles Count'l, California, said right of way
being reserved in the deeds from M.C. Cooper and wife to
Charles M. Scott and wife recorded September 20, 1913 in Book 234,
page 113 and in Book 230, page 92 of Deeds, records of said
Orange County.
Parcel 2: An easement for road and public utility purposes,
recorded May 31, 1978 in Book 12696, page 1392 of Official
~ecords, more particularly described as follows:
The Easterly 32.00 feet, as measured at right angles to the
center of Eaton Way, of the following described land:
Beginning at a point in the centerline of Eaton Way, 40.00 feet
wide, as described in deed recorded in Book 852, page 82 of
Official Records, distant along said centerline S 000 28' 07" W,
420.59 feet from the centerline of Ball Road, 60.00 feet wide,
as described in said deed, said point also being the northeasterly
terminus of that certain course described as a curve concave
Southeasterly and having a radius of 1000.00 feet in Parcel 3A
of the Final Order of Condemnation, Superior Court Case No. 145654,
a certified copy of which was recorded March 23, 1967 in Book 8206,
page 807 of Official Records; thence Southwesterly along said
curve from a tangent which bears S 560 59' 23" W, through a central
angle of 350 53' 58" an arc distance of 626.56 feet to' the center-
line of Taft Avenue, 40.00 feet wide, as described in said deed;
thence Easterly and Northerly along said centerlines of Taft Avenue
and Eaton Way to the point of beginning.
Excepting therefrom those portions described as Parcel 3B and
Parcel 3C in that certain Final Order of Condemnation, Superior
Court Case No. 145654, a certified copy of which was recorded
~1arch 23, 1967 in Book 8206, page 807 of said Official Records.
Parcel 3: A spandrel shaped parcel bounded on the East by the
West line of the herein above described Parcel 2, bounded on
the South by the North right of way line of Taft Avenue, 40.00
feet wide, as described in deed recorded in Book 852, page 82 of
Official Records, bounded on the Northeast by the arc of a curve
concave Northwesterly, having a radius of 25.00 feet, being tangent
to said East and South lines.
Excepting from said Parcels 1, 2 and 3 above any of said land
included within Taft Avenue.
