TERIALS AND EQUIPMENT AND ALL UTILITIES .AND TRANS-
PORTATION INCLUDING POWER v FUEL AND WATERg AND
PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND

WHEREAS, the City Counoil of the City of Anaheim did
oause to be published in a newspaper of general oiroulation,
printed, published and oiroulated 1n the City of Anaheim, to vitt
The Anaheim Gazette. on the 18th and 2Sth davs of June. ,
19~. a notice inviting sealed proposals for furnishing the
following:
All plant, labor, services, materials and equip-
ment, and all utilities and transportation,
including power, fuel and water, and performing
a.ll work necessary to construct and complete in
8 good and wor]{Jnanl ike manner, in strict accordance
with the specifications, plans and drawings there-
for on file in the Office of the City Engineer or
the City Clerk of the City of Anaheim, and the
contract documents, the following public improve-
ment, to wit: The construction and completion
of a rigid frame, fabricated steel building at
the Northeast corner of Crescent Pvenue and
Brookhurst Street, in the City of Anaheim,
behind fire Station No.2, including all
appurtenant work, Job No. Lj54.

and the notioe inviting sealed proposals, vhio said notioe speoi-
fied that sealed proposals as speoified 1n said notioe would be
reoeived up until 2:00 o'olook PoX. of the __.fnd day of
July . 1959 , and whioh said notioe d1d state and
deolare that, pursuant to the provisions of Seotion 1770 of the
Labor Code. the City Counoil of the City of Anaheim had ascerta1ned
the prevailing rate of wages for eaoh type of labor needed to exe-
oute said oontract and did set forth the prevailing hourly vage
soale 80 asoertained; and .
WHEREAS, on July c. , 19....21.. at the hour of

City of Anaheim did open said sealed proposals reoeived up to that
time for the furnishing of all plant>> labor>> servioes, materials
and equipment, and all utilities and transportation>> inoluding
power>> fuel and water>> and performing all work neoessary to con-
struct and complete. in a good and workmanlike manner. in strict
aooordance with the specifications. plans and drawings therefor
on file in the Offioe of the City Clerk of the City of Anaheim,
the public improvement hereinabove more particularly described and
set forth. in publio>> in the City Counoil Chamber in the City Hall,
Anaheim, California, and the City Engineer did tabulate the result
of said sealed proposals and did make a report to the City Council
at its next ad iourned regular meeting; and
WHEREAS. the City Council of the City of Anaheim did>> at
its next ad iourned regular meeting. held on the 7th day
of July >> 19~, at the hour of 7:00 o'olock P.K.,
consider the sealed proposals submitted for furnishing the materi-
als and performing the work hereinabove more particularly described
and set forth. and did thereupon find and determine that the sealed
proposal submitted by FASCOE STEEL CORPORATION. 1 ;01 E. I p.xinQton,
Pomona, California,
for the construotion. installation and completion of said stp.pl hllild-

hereinabove mentioned and desoribed. was the lowest responsible
proposal submitted therefor. and thereupon acoepted said bid and
did award a contraot to said P~COE STEEI CORPORATTON
for furnishing all plaht. labor>> servioes. materials and equipment
and all utilities and transportationD including power, fuel and
water. and performing all work necessary to construot and complete.
in a good and workmanlike manner. in strict accordance with the
specifications>> plansp and drawings. the said pUblic improvement as
speoified in said notice inviting sealed proposals>> and did author-
ize the Mayor and the City Clerk of the City of Anaheim to exeoute
a contraot for and on behalf of the City of Anaheim with

which said contract was duly made and entered into on the Rth

and transportation. and performed all work necessary for the oon-
struction and completion>> in a good and workmanlike manner>> in

pUblio improvement as specified in the notice inviting sealed pro-
posals and in the detail, designp plans>> profiles, drawings and

into with it by the City of Anaheim; and
WHEREAS>> the Ci tv Eno ineer has dull
certified to the construotion and oompletion of said publio improve-
ment hereinabove mentioned and desoribed. in aocordanoe with the
plans and speoifioations and the contraot documents duly made and

WHEREAS. the Oity Council finds that said oontraotor haa
completed said pUblio improvement hereinabove more particularly de-
scribed in aooordanoe with the prOVisions of the contract and the
oontract doouments, and that notioe of completion should be filed
and payment of the balance due said oontraotor authorized in aooord-
ance with the contract documentso

NOW, THEREFORE, BE IT RESOLVED by the Oity Oouncil of the
Oity of Anaheim that all plant, labor. services, materials and
equipment and all utilities and transportation, and the pertormanoe
o! all work necessary to oonstruct, install and complete. in a good
and workmanlike manner, in strict accordanoe with the specifica-
tions, plans and drawings therefor on tile in the Office of the Oity
Olerk of the Oity of Anaheim, together with the appurtenanoes
thereto, said publio improvement hereinabove more particularly de-
soribed and set forth, in the Oity of Anaheim, by said oontraotor,
be, and the same are hereby aooepted. subJeot, nevertheless, to all
the terms, conditions and provisions of the oontraot doouments, and
that the balance due said oontraotor for said work be paid to it
thirty-five (35) days from and after final acoeptanoe of said work
as evidenoed by the adoption of this resolution, but not sooner than
thirty (30) days after the date of the filing of notioe of oom-
pletion, exoepting only suoh sum or sums as may lawfully be withheld
in accordanoe with the provisions of said oontraot and oontraot
doouments. That aooeptance by the oontraotor of said payments made
in aocordance with said final estimate shall operate and shall be a
release to the City of Anaheim, its offioers. agents and employees
from all olaims and liabilities due the contraotor for anything
done or furnished or withheld or for anything relating to the work
or any act or negleot of the Oity, its offioers. agents and em-
ployees, excepting only olaims against the Oity for any amounts
withheld by the Oity at the time of suoh payment.
AND BE IT FURTHER RESOLVED that the Mayor and the Oity
Olerk of the City of Anaheim be, and they are hereby authorized to
exeoute and file a notice of oompletion of said work as required
by law.
THE FOREGOING RESOLUTION is approved and signed by me
