A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING A CO~WJUNlCATIONS AGREE-
MENT TO BE V~E AND ENTERED INTO BY THE COUNTY
OF ORANGE AND THE CITY OF ANAHEIM FOR THE ES-
TABLISHMENT OF REVDTE CONTROL FACILITIES IN
AND FOR THE USE OF THE CITY IN THE POLICE RADIO
SERVICE; AND AUTHORIZING THE IViA.YOR AND CITY
CLERK TO EXECUTE SAID AGREEMENT FOR AND ON
BEHALF OF THE CITY.
ViHEREAS, the Coun ty of Orang e owns, ma in ta ins and
operates a communication system for public safety communications
in the police, fire and special emergency services; and
WHEREAS, the City of Anaheim desires the County to
establish Remote Control Facilities in and for the use of the
City in the Police Radio Service and is desirous of having same
maintained under a licensed supervising technician of the County
of Orange; and
vr.~EREAS, the County of Orange has offered to establish
said Remote Control Facilities in and for the use of the City
upon the terms and conditions set forth in a form of Cornmuni-
cations Agreement this day submitted to the City Council; and
WHEREAS, the City Council finds that the terms and
conditions of said agreement are fair and reasonable and that
said Communications Agreement should be approved, and the Mayor
and City Clerk authorized to execute the same for and on behalf
of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Communications Agreement this day
submit ted to the City Counc i1 by the County of Orange, to be
made and entered into by and between the City of Anaheim and
the County of Orange, the terms, covenants and conditions of
which are as hereinafter set forth, be and the same is hereby
approved. That said terms, covenants and conditions are as
follows:
1. (a) The County shall install and maintain Remote
Control Facilities for police use by and in the City of Anaheim
connecting the City through Remote Control Facilities with the
County communications system, under the rules and regulations of
the Federal Communications COarylission. Before the County pro-
vides said service, the City shall obtain a Federal Communi-
cations Commission license in the Police Radio Service, author-
izing the operation of all of the City1s mobile units which are
to be furnished base station service by the County.
(b) The County shall also install and maintain
base station facilities for fire radio service, and special
emergency radio service limited to Civil Defense County-wide
communication system.
(c) The County shall install and maintain radar
speed meters, pack sets, surveillance equipment and other elec-
tronic equipment used by the City in carrying out the official
functions of the police and fire services.

(d) Nothing in the agreement shall authorize or
be construed as requiring the County to install or maintain any
equipment of any kind in vehicles, buildings, or premises not
owned by or under lease to the City and under the full-time
control of the City.
(e) All charges for labor in connection with
installation and maintenance shall be borne by the County. All
equipment, material, apparatus and parts required for instal-
lation and maintenance shall be furnished by and at the expense
of the City.
2. The County shall furnish a licensed supervising
technician, and said Remote Control Facilities shall be under
the supervision of said licensed technician, who shall hold a
valid first-class radio telephone license issued by the Federal
Communications Commission.
3. Said qemote Control Facilities shall be in con-
tinuous connection with the dispatching point of the County
Communications Center, whenever the City provides office dis-
patching personnel for a minimum of sixteen (l6) hours per day,
and the Police Officers of the City shall be permitted to
dispatch over the air at any time the System is not actually
being used by other authorized agencies of Orange County uti-
lizing said System.
L. That any message of important emergency nature
shall have preference over any routine traffic and the facilities
for dispatching such emergency messages shall be made available
upon request. In case of a dispute over priority of emergency
messages originating in more than one department, the dispatcher
on duty at Ule County Communications Center shall be the final
authority in deciding which emergency message shall have priority.
;-. The City proposes to use said Communications System
only for such purposes and in such manner as may be permitted by
the Federal Communications Cormnission. The dispatcher on duty
at the Communications Center shall monitor all dispatches and
shall have the authority to take said Remote Control Facilities
off the air should any rules or regulations for the management
of the County Communications Center, as adopted by the Board of
Supervisors, or any rules and regulations adopted by the Federal
Communications Commission, or the Federal Communications Act of
1934, as amended, he violated.
6. That so long as the agreement remains in effect,
the City will not apply to the Federal Communications Commission
for a license or individual authority to operate a base station
transmitter in the Police Radio Service, unless it shall have
first oiven notice of cancellation to the County as provided in

7. All radio equipment on mobile equipment of the
City o?erating in the Publ ic Safety li.adio Services shall be in-
stalled and maintained by UI.e County. The City shall furnish,
at its expense, all material and supplies for installation and
'naintenance on said mobile equipm8nt. Such installation and
maintenance herein referred to shall be limited to Radio Com-
munications equipment operating within the following categories:
Police Eadio Service, Fire Radio SerVice, Special Emergency Radio
Service 1 incited to Civil Defense CountY-Hide Communications.

u. The agreement shall become effective on the first
day of the month following its execution, and thereafter may be
canceled by either party upon six (6) months' notice given to
the other party thereof.
9. The agreement shall supersede all agreements hereto-
fore entered into between the County and the City relating to
radio c07:11T1unications and the installation and maintenance of radio
transmission equipment, and upon the execution of said agreement,
all suc1: pr ior agreements s112.11 be cons idered as of no further
force or effect.
BE IT FURTHER :i.ESOLVED that the i"layor and City Clerk
be, and they are hereby, authorized to enter into said agreement
for and on behalf of the Ci ty of Anahe im.
