A RESOLUTION OF THE CITY COUNCIL 0' THE CITY or
ANAHEIM FINALLY ACCEPTING THE OOXPLETION AND THE
FURNISHING OF ALL PI..ANT ~ LABORp SltRVICES~ XA-
TERIALS AND EQ,UIPKENT AND ALL UTILITIES AND TRANS-
PORTATION INCLUDING POWER, FUEL AND WATER, AND
PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND
COMPLETE THE FOLLOWING PUBLIC IMPROVEKENT $ TO WI'f:
THE IMPROVE~~NT OF SYCAMORE STREET. FROM BUTTONWOOD
~ET To~OlIVE STREET. PROJECT NO. 76.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general oirculation,
printed, published and circulated in the City of Anaheim, to wit:
The Anaheim Gazette, on the 16th and 2ird qavs of April .
19~, a notioe inviting sealed proposals for furnishing the
following~
All plant, labor, services, materials and equipment,
and all utilities and transportation; including power,
fuel and water, and performing all work necessary to
construct and complete, in a good and workmanlike
manner, in strict accordance with the specifications,
plans and drawings therefor on file in the office of
the City Clerk or City Engineer of the City of Anaheim,
the following public improvement, to wit: The Improve-
ment of Sycamore Street, from Buttonwood Street to
Olive Street, by excavation, including removal of
existing materials, construction of 4-inch plant-mix
surfacing, including paint binder and weed killer,
adjusting existing manholes and existing water valve
covers to grade, installation of standard paddle
boards, and appurtenant work as indicated on the plans,

in aooordance with the designsB plansD prOfiles and specifioa-
tions prepared by Thornton E. Piersall, C.it}T F.ngineer=
and the notioe inviting sealed proposalsB whioh said notioe speoi-
fied that sealed proposals as speOified in said notioe would be
received up until. 2:QO o'olook PoMp of the ~Oth day of
Ap~tl . ~9~. and Y~oh said notioe did state and
declare that, pursuant to the provisions of Section 1110 of the
Labor CodeD the City Counoil of the City of Anaheim had ascertained
the prevailing rate of wages for eaoh type of labor needed to exe-
oute said oontract and did set forth the prevailing hourly wage
scale so ascertained; and .
WHEREAS. on April 30 D 19 59 ,at the hour ot

City of Anaheim did open said sealed proposals received up to that
time for the furnishing of all plant. labor~ services. materials
and equipment, and all utilities and transportation. including
power. fuel and water, and performing all work necessary to oon-
struot and oomplete. in a good and workmanlike manner. in striot
accordanoe with the specifioations. plans and drawings therefor
on file in the Offioe of the City Clerk of the City of Anaheim.
the public improvement hereinabove more particularly described and
set forth. in publios 1n the City Council Chamber in the City Hall,
Anaheim, California. and the Oity Engineer did tabulate the result
of said sealed proposals and did make a report to the City Council
at its next adiourn~regular meeting; and
WHEREAS. the City Council of the City of Anaheim did. at
its next adjourned regular meeting. held on the ~th day
of Hay. .., 19~, at the hour of 7:00 ololook P.M.,
oonsider the sealed proposals submitted for furnishing the materi-
als and performing the work hereinabove mOre partioularly described
and set forth9 and did thereupon find and determine that the sealed

proposal submitted therefor~ and thereupon accePted said bid and

water" and performing all work necessary to construct and oomplete,
in a good and workmanlike manner. in strict acoordance with the
speCifications. plans. and drawings. the said pUblic improvement as
specified 1n said notice inviting sealed proposals>> and did author-
ize the Mayor and the City Olerk of the City of Anaheim to exeoute
a contract for and on behalf of the City of Anaheim with R, J NOR1F
COMPANY, p. O. Box 620. O~anqe. California $
whioh said contract was duly made and entered into on the 7th
day of May . 19~,; and
WHEREAS, the said R. J. NOBl.,E COMPANY
has furnished all
plant, labor. servioes~ materials and equipment and all utilities
and transportation. and performed all work neoessary for the oon-
struction and oompletion" in a good and workmanlike manner. in
striot acoordance with the speoifications. plans. drawings. of said
public improvement as specified in the notice inviting sealed pro-
posals and in the detail, design. plans. profiles, drawings and
specifications prepared by Thornton E. Piersall. Citv Enoineer
, and the contraot made and entered
into with it by the City of Anaheim; and
WHEREAS. the CU,~ Engineer ,_..._~ha.s dull
certified to the construction and oompletion of said pUblic improve-
ment hereinabove mentioned and describedD in accordanoe with the
plans and speoifioations and the contract documents duly m~le and

WHEREAS. the City Council finds tr~t said contractor has
oompleted said public improvement hereinabove more partioularly de-
soribed in accordanoe with the provisions of the oontract and the
contract documents. and that notice of completion should be filed
and payment of the balance due said oontractor authorized in aooord-
ance with the contract documents.

NOW D THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that all plant, labor, services, materials and
equipment and all utilities and transportation, and the performanoe
of all work necessary to construotD install and complete, in a good
and workmanlike manner. in strict aocordance with the specifioa-
tionsD plans and drawings therefor on file in the Offioe of the City
Clerk of the Oity Of Anaheim, together with the appurtenanoes
thereto. said pUblic improvement hereinabove mOre particularly de-
scribed and set forth, in the City of Anaheim, by said oontractor,
be. and the same are hereby accepted. subJect, nevertheless, to all
the terms>> conditions and provisions of the contraot documents. and
that the balance due said contractor for said work be paid to it
thirty-five (35) days from and after final acceptance of said work
as evidenoed by the adoption of this resolution, but not sooner than
thirty (30) days after the date of the filing of notice of oom-
pletion>> excepting only such sum Or sums as may la~ully be withheld
in aocordanoe with the provisions of said contract and contraot
documents. That acceptance by the contractor of said payments made
in aocordance with said final estimate shall operate and shall be a
release to the City of Anaheim, its officers. agents and employees
from all claims and liabilities due the contraotor for anything
done Or furnished or withheld or for anything relating to the work
or any act Or negleot of the City, its offioers, agents and em-
ployees. excepting only claims against the City for any amounts
withheld by the City at the time of such payment.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Olerk of the City of Anaheim be, and they are hereby authorized to
execute and file a notioe of oompletion of said work as required
by law.
