A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ~PROVING AN AGREEMENT FOR THE
MAINTENANCE OF CERTAIN PROPERTY BELONGING TO
THE MAGNOLIA ELEMENTARY SCHOOL DISTRICT, AND
USED IN THE JOINT CO}mUNITY RECREATION PRO~
GRAI1 OF THE CITY OF ANAHEIM, THE ANAHEIM UNION
HIGH SCHOOL DISTRICT, THE ANAHEIM CITY SCHOOL
DISTRICT, AND THE MAGNOLIA ELEMENTARY SCHOOL
DISTRICT: AND AUTHORIZING THE MAYOR AND TEE
CITY CLERK TO EXECUTE SAID AGREEMENT.
WHEREAS, the City of Anaheim and the Magnolia
Elementary Sohool Distriot, together with the Anaheim Union
High Sohool Distriot and the Anaheim City Sohool Distriot,
have previously entered into an agreement for a joint program
of community recreation; and
WHEREAS, the City Council does hereby determine that
in aid of said program, it is necessary and convenient to enter
into an agreement whereby certain property owned by the Magnolia
Elementary School Distriot, should be maintained by the City of
Anaheim under the provision that the cost of such maintenance
should be borne by the Magnolia Elementary School District;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City of Anaheim enter into an
agreement for the maintenance of certain property, owned by the
Magnolia Elementary School District, by the City of Anaheim on
the fOllOwing terms:
1. The City of Anaheim shall use its equipment
and furnish all necessary labor, water,
electricity, and other supplies for the
maintenance of those parcels of land owned
by the Magnolia Elementary School District
which are adjacent to park property owned
by the City of Anaheim, and which are open
grounds not covered by buildings or other
structures or facilities, and which are
used in the community recreation program,
it being understood that the agreement ahall
be for ground maintenance only.
2. The Magnolia Elementary School District shall
pay to the City of Anaheim, on demand, all
actual expense incurred by the City of Anaheim
for such maintenance, including expense for
labor, compensation insurance, retirement, and
the actual cost to the City of Anaheim for all
commodities and materials used or expended for
such maintenance, plus an overhead and adminis-
trative cost of fifteen (15) per cent of said
actual cost.
3. The City of Anaheim shall submit itemized
demands to the Magnolia Elementary School
District once each month during the term of
said agreement for maintenance expense, for
the prior month.

The term of said agreement shall be from
March 1, 1959 through June 30, 1960, and
may be extended from month to month after
the expiration of said term by mutual
agreement, by motion of the governing
bodies of both parties to said agreement.

BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute an agreement for and on behalf of the
City of Anaheim with the Magnolia Elementary School District for
the purposes and upon the conditions set forth in this resolu-
tion.
THE FOREGOING RESOLUTION is approved and signed by
me this 1st day of September, 1959.
