4026ORDINANCE NO. 4026 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. _ determining that a change or changes in t e zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: The North half of the Northeast quarter of the Southeast quarter of Section 22, Township 4 South, Range 10 West, as shown on a Map filed in book 15, page 4 of Record of Surveys in the office of the County Recorder of Orange County, Califor- nia. Excepting therefrom that portion of said land lying Southwesterly of the Northeasterly line of that certain parcel of land conveyed to Pacific Improvement Company by deed recorded I1Iay 12, 1888 in book 434, page 269 of Deeds, records of Los Angeles County, California: Also excepting that portion described in deed to the State of Califor- nia, recorded April 29, 1952 in book 2322, page 139 of Official records. Also excepting the inter- est, if any, in that portion thereof included within Tract No. 1903 as shown on a !,lap recorded in book 23, page 50 of Miscellaneous Maps, records of Orange County, California. -1- ATT Y-2 8 78-79-2 PARCEL 2: The West 198 feet of the northwest quar- ter of the northwest quarter of the Southwest quar- ter of Section 23, being a portion of Lot 41 in Town- ship 4 South, Range 10 west, as shown on a Map recorded in boo'L 2, pages 256 and 257 of Patents of Los Angeles County, California. Excepting therefrom that portion thereof included within that certain parcel of land described in deed to the State of California recorded in boot: 276, page 160 of Official Records of said County. Also excepting therefrom that por- tion included within Parcel 6 as shown on a Map filed in Boot 4, pages 5 to 11 inclusive, of State Highway Maps, records of said Orange County, now is "ML" INDUSTRIAL, LIMITED ZONE and that it be changed to and incorporated in "CL" COi\Cv1ERCIAL, LIMITED ZONE, subject to the fol- lowing conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That subject property shall be served by underground atilities. -3- 4. That an eight (6) foot high masonry block wall shall be constructed along the north property line. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That all private streets shall be developed in accord- ance with the City of Anaheim's standards for private streets. 7. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. o. That the owner(s) of subject property shall pay the traffic signal assessment fee (Council Policy #214) amounting to $30.00 per 1000 square feet of building or fraction thereof for industrial building numbers 1, 2, 5 and 6 on the submitted exhib- its and $363.00 per 1000 square feet of building or fraction thereof for commercial building numbers 3, 4, 7 and 8, on the sub- mitted exhibits, prior to the issuance of building permits. 9. That the owner(s) of subject property submit a letter requesting the termination of Conditional Use Permit No. 1027 prior to the issuance of a building permit. 10. That Condition Nos. 1, 3, 4, 5 and 6, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. SECTI0N 2. `The City Zoning Iap shall be, and the same is hereby, amended and the property above-described shall be excluded from ti -le zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning i'.'iap showing; the changes hereby approved and adopted. SECTION 3. ;�'he City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
