RESOLUTION NO. 5439
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF
ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY,
A~D THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM
MUNICIPAL CODE SHOULD BE AY;ENDED TO ACCOMPLISH
SAID CHANGE OF ZONE"
WHEREAS, the City Planning Commission of the City of Anaheim
has heretofore duly passed and adopted a resolution declaring its inten-
tion to change the boundaries of the zone or zones hereinafter men-
tioned and described and did fix a time and place for the holding of
a public hearing thereon in the manner and as prescribed in Article
IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and
',onduct sU0h public hearing to consider said proposed change of zone
or zones. and did receive evidence and reports from persons interested
therein; and
WHEREAS, within a period of forty (40) days following the
fi.nal hearing thereon, the Planning Commission did duly announce by
formal resolution its findings of facts and declare its opinions and
reasons for recommending an amendment to said Article IX, Chapter 2
of the Anaheim Municipal Code to effect the proposed changes in the
houndaries of the zone hereinafter mentioned and described; and
WHEREAS, upon receipt of the report and recommendation of
the City Planning Commission, the City Council did thereupon fix the
18th day of ~f~st , 19_59 , as the time and the
Conncil Chamber in the y Hall of theLrrty of Anaheim as the place
for a public hearing upon said proposed change of zone, and did give
notice thereof in the manner and as provided in said Article IX,
Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public hear-
ing, the City Council did duly hold and conduct such public hearing
'lnd did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and did thereupon con-
sider the recommendations of the City Planning Commission; and
WHEREAS, the City Council does find and determine that the
property and area proposed to be changed from the zone in which it
is now situated to a different zone, as hereinafter set forth, is
more suitable for the zone or zones to which it is proposed to
~,hange said property and area and that the inclusion of said property
and area in such new zone or zones will increase the value of said
property and area and will not depreciate the values of property
in adjoining zones.
NOW, THEREFOREj BE IT RESOLVED by the City Council of the
City of Anaheim that all of' the property and area situated in the
City of Anaheim, County of Orange. State of California, described
as follows, to wit:
The West half of the Northeast quarter of the Southwest
quarter of the Northwest quarter of Section 16, Township
~- South, Range 10 West, in the Rancho San Juan Cajon de
Santa Ana, City of Anaheim, County of Orange, State of
California, and being the West half of Lot 11 of Helen
and Lynch's Subdivision of the West half of Section 16,
Township 4 South, Range 10 West, as per map recorded in
Book 442, Page 158 of Deeds, in the office of the County
Recorder of Los Angeles County, California, the east line

of the above described land being the same as the
west line of the tract of land conveyed by Charles
Schindler and wife, to Nettie Eygabroad by deed
recorded March 15, 1909 in Book 163, Page 387 of
Deeds.
EXCEPT that portion thereof described as follows:
Beginning at a point on the north line of said land
80.00 feet West of the Northeast corner thereof;
thence South 250.00 feet; thence West 90.00 feet;
thence North 250.00 feet; thence East 90.00 feet to
the point of beginning.
ALSO EXCEPT that portion thereof described as follows:
Beginning at the Northeast corner; thence West along
the north line thereof 80.00 feet; thence South 250.00
feet; thence West 90.00 feet; thence South 100.00
feet; thence East 170.00 feet to the west line of the
tract of land conveyed to Nettie Eygabroad; thence
North 350.00 feet to the point of beginning.
ALSO EXCEPT that portion thereof occupied by Broadway
on the north.
be changed from R-A, RESIDENTIAL-AGRICUL~RAL ZONE to C-l,
NEIGHBORHOOD-COMJVIERCIAL ZONE, upon the following cond it ions:
1. That the owner of subject property deed to the City
of Anaheim a strip of land 45 feet in width, from
the center line of the street, along Broadway
Street, for street widening purposes.
2. (a) That all engineering requirements of the City
of Anaheim, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities, or
other pertinent work be complied with as required
by the City Engineer and in accordance with stand-
ard plans and specifications on file in the office
of the City Engineer; and (b) that a bond in an
amount and form satisfactory to the City of Anaheim
be posted with the City to guarantee the instal-
lation of said engineering requirements.
3. That the owner of subject property pay to the City
of Anaheim the sum of -$2.00 per front foot for
street lighting purposes.
h. That all buildings to be erected on subject property
shall be constructed and located on the land in
conformity with the layout or plot plan submitted
as a part of the application, and on file with the
City of Anaheim; and all buildings shall be limited
to one story in height.
5. T~at the owner of subject property place of record
standard City of Anaheim C-l Deed Restrictions,
approved by the City Attorney, which restrictions
shall limit the C-l uses of the property to Banks,
IVIedical and Dental Offices, Pharmacies, Professional

Offices, Non-Retail Service Businesses, and any
uses, except Restaurants, which may hereafter be
authorized and permitted under future zoning of
the City of Anaheim in the proposed C-7, Business
and Professional Office Zones; and shall limit
all buildings constructed on said property to one
story in height.
6. That all of the above conditions, with the exception
of Conditions Nos. 2(a) and 4, shall be complied
\-lith with in a per iod of 90 days from date hereof,
or such further time as the City Council may grant.
BE IT FURTHER HE SOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be neces-
sary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 18th day of August, 1959.
