59R-5405 RESOLUTION NO. 5405 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA- HEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CON- TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW- ING PUBLIC IMPROVEMENT: THE BROOKHURST STREET SEWER IMPROVEMENT. FROM BALL ROAD TO 960 FEET SOUTH OF BALL ROAD. JOB NO. 1163. WHEREAS, the City Council of the City of Anaheim did cause t.o be published in a newspaper of general circulation, printed, PUblished and circulated in the City of Anaheim, to wit: The Anaheim Gazette on the 16th and 23rd days of Julv. 19S9. a notice inviting sealed proposals for furnishing the following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the speCifications, plans and drawings therefor on file in the office of the City Engineer or City Clerk of the City of Anaheim, the follow- ing public improvement, to wit: The Brookhurst Street Sewer Improvement, consisting of the construction of an 8-inch V.C.P. sewer lateral in Brookhurst Street, from Ball Road to 960 feet south of Ball Road, including excavation, trenching, backfill and flooding, resurfacing, construction of manholes, construction of 4-inch house laterals, and appurtenant work as indicated on the plans, Job No. 1163, in accordance with the design, plans, profiles and specifications of said public improvement on file in the office of the City Clerk of the City of Anaheim; and WHEREAS, said notice inviting sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the office of the City Clerk of the City of Anaheim up to the hour of2:00 o'clock P.M. on the 30th day of Julv , 19~, for the furnishing of all plant, labor, services~ materials, and equipment, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complet.e in a good and workmanlike manner, the public improvement hereinabove. more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Counl'3il of the City of Anaheim bad ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract and did set forth the prevailing hourly wage scale so ascertained; and WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 30th day of Julv , 19...52..-, in response to the notice aforesaid inviting sealed proposals, to wit: -1- NAME PLUMB ING CONTRACTORS, INC., SAN lTARY D IVI S ION ORANGE COUNTY CONS T. INC.. SANITARY DIVISION. 11662 ~_ Westminster. Avenue. Santa Ana. California. is the lowest .responsible proposal submitt.ed f.or the.furnishing ..ofall plant, labor~. services,mat.erials and equipment,. allut.ilities..and transportation, including power, fuel and water and perf'.orming all wark necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings there- for on file in the office of the City Clerk of the City of Ananeim, the public improvement hereinabove mentioned and described,. together with the appurtenances thereto, and as specified in the 1'0tic.e. inviting sealed proposals, and that said proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the City Council finds that the above ment.i.oned sealed proposal is the lowest responsible proposal recei v.ed and that..theper- stm, firm or corporation submitting said propos.al is a resp.onsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinaq'Qve set forth, shall be, and they are hereby required to execut.e a contr~ct in the required form with the City of Anaheim upon the terms.and condit.ions specified in the notice inviting sealed proposals and the proposal submitted by said success- ful bidder or bidders and in accordance with the plans and specifica- tions for said public improvement hereinabove described, and in accord- -2- ""_..~._~.~----"',.,,~.~.~-~ ance with the terms, conditions and provlslons of this reEulutio~, and that said successful bidder or bidders to whom each c.ontract is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100%) of the contract price for- all l:lbor, materials and equipment to be furnished and performed, as s.e.t forth in the sealed proposal submitted by said bidder for the construction of said public improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract, as ~~curity for the faithful performance of said contract and a separa-te surety bond in an amount equal to one hundred per cent (100%) of the oon- struction cost of said public improvement covered by saidoontract, as security for the payment of all persons performing labor.and fur- nishing material for said projecto AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim,-.public. lia- bility, property damage, compensation, and other insurance~ in the amounts and for the purposes as set forth and specified in the :tlotice inviting sealed proposals, and subject to the approval of the City Attorney as to form and sufficiency.
