59R-5404 RESOLUTION NO 0 5404 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE (NO. 1131). ,- WHEREAS. the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the prop- erty owner and/or purchaser of certain real prop- erty situated in the City of Anaheim, County of Orange, State of California. described as follows: Tracts Nos. 2832 and 2938JO recorded in Boo,", 119, Paoes 26 and 27 00 Miscellaneous Maps, records of Or~nge County, an Book 119, Pages 28 and 29 of Miscellaneous Maps, records of Orange County, I' e spe c t i v.~ 1 y. AND WHEREAS. the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on June 29. 1959 . notices of which said public hearing were duly given as required by law and the provisions of Section 9200<17 of the Anaheim Municipal Code; and WHEREAS. said Commission. after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No< 268 ,recommending to the City Coun- cil of the City of Anaheim that Variance No. 1131 be granted upon the conditions stated in said resolution; and WHEREAS. the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting or such variance will not ad- versely affect the comprehensive general zoning plan 0 NOW THEREFORE, BE IT RESOLVED by the City Council of the City or Anaheim that a conditional zoning variance be, and the same is hereby granted to BUTLER-F..ARBOUR CONSTRUCTION CO., 9741 Lincoln Avenue, Anaheim, Cali~ornia, permitting a reduction in the minimum ~ront yard setback requirements on all interior lots in -1- Tracts 2832 and 2938 from 25 feet to 20 feet; but granting no reduotion in the minimum front yard setback requirements, as provided in the Anaheim Municipal Code, for the remainder of the lets in said tracts. The City Council hereby reserves the right to revoke such variance perMit for good cause or failure of said owner_, its ~~ successors or assigns, to comply with the Anaheim Municipal Code and re~llations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. 4th THE FOREGOING RESOLUTION is si$ned and approved by me this day of August , 19 59 .
