RESOLUTION NO. 5321
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1120.
WHEREAS, the City Pl~nning Commission of the City of
Anaheim did receive a petition for zoning variance from the
property owner of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as
follows:
That certain real property located in the County
of Orange, State of California, being a portion
of the East 5 acres of the South half of the South-
east quarter of the Southwest quarter of Section
13, Township 4 South, Range 11 West, in the Rancho
Los Coyotes, more particularly described as follows:
Commencing at the Southeast corner of said South
half of the Southeast quarter of the Southwest
quarter; thence North 0009'35" East along the East
line of said South half 396.40 feet to the true
point of beginning of this description; thence South
89058'35" West parallel to the North line of said
East 5 acres, 329.71 feet to the West line of said
East 5 acres; thence South 0009'35" West along said
West line, 396.34 feet to the Southwest corner of said
East 5 acres; thence North 89059'15" East along the
South line of said East 5 acres, 329.71 feet to the
Southeast corner of said East 5 acres; thence North
0009'35" East along the East line of said East 5
acres, 396.40 feet to the true point of beginning.
Containing an area of 3,000 acres, more or less.
EXOEPTING THEREFROM that portion of Dale Street
deeded to the Oounty of Orange.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on June 2, 1959, notices of which said public hearing
were duly given as required by law and the provisions of Section
9200.17 of the Anaheim MuniCipal Code; and
WHEREAS, said CommiSSion, after due inspeotion, investi-
gation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. 243, recommending to the City Counoil
of the City of Anaheim that Variance No. 1120 be granted upon the
conditions stated in said resolution; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property

right possessed by other property in the same
vicinity and zone and denied to the property
in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare
or injurious to the property or improvements in
such vicinity and zone in which the property is
located.
4. That the granting of such variance will not
adversely affect the comprehensive general zoning
plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to Liborio Sclifo, 859 West 14Gth Street,
Gardena, California, to use the existing house located on the pro-
perty hereinabove described for a residence and real estate broker's
office, for a period of one year from date hereof, upon the follow-
ing conditions:
That the owners of subject property deed to the
City of Anaheim a strip of land 53 feet in width
from the center line of the street, along Ball
Road, for street widening purposes; and a strip
of land 45 feet in width from the center line of
the street, along Dale Avenue, for street widen-
ing purposes.
That all engineering requirements of the City of
Anaheim, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities or
other pertinent work, along Ball Road and Dale
Avenue on that portion of subject property to be
used for business purposes, be complied with as
required by the City Engineer and in aocordance
with standard plans and specifications on file in
the office of the City Engineer.
That a black-topped, off-street parking area be
provided for the parking of four (4) cars.
That the owners of subject property pay to the
City of Anaheim the sum of 12.00 per front foot
for street lighting purposes, on both Ball Road
and Dale Avenue on that portion of the property
to be used for business purposes.
That the maximum size of any sign to be erected
on said property shall be 4' x 81.
The City Council hereby reserveathe right to revoke such
variance permit for good cause or failure of s~id owner, his heirs,
successors or assigns, to comply with the Anaheim Municipal Code
and regulations and the conditions herein.
