59R-5320 RESOLUTION NO. 5320 A RESOLUTIOH OF TEE eI'n COUNCIL OF THE CITY OF ANAH~IM FINDING AND DETEffi1INING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution re- c:ommend:i.ng denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim t1unicipal Code, and after having duly held and conducted such public hearinS to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearin,; thereon, the Planning Commission did duly announce by formal resolution its findin,::s of facts and declare its opinions and reasons for recommendj.nz that said proposed change in the boundaries of the zone or zones hereinafter mentioned and described be denied; and WHEREAS, upon receipt of the report and recommendation of' the City Planning Commission, the City Council did thereupon fix the 30th day of ~Jne, 1959, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim tJ!unicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of t~e City Planning Commission; and W'rIEREAS, the City Council does find and determine that the property and area proposed to be chan~ed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said pro- perty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoinin~ zones. NOW, THEREFORE, BE IT RESOLVED by the City Councilor the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, des- cribed as fOllows, to wit: Lot 16 in Block K oE the Kraemer Tract, recorded in Book 12, Pages 87 and 88, Miscellaneous Records of Los Angeles County, California, be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to the follow- ing zones, upon the conditions hereinafter set forth: -1- F'-58-59-87 That a strip of land 50 feet in width along Anaheim Road and a strip 50 feet in width along La Palma Avenue be cnan::;ed to P-L, PAHKING-LANDSCAPING ZONE; and That the balance of subject property be changed to 1'1-1, LIGHT-NAN'JI<'Ar;'l''1lnnG- ZONE, upon the following conditions: 1. That the owners of' s:"~bject property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Anaheim Road for street widenins purposes; and a strip of land 53 feet in width, from the center line of the street, alon: La Palma Avenue for street widening purposes. 2. That all engineerinr; J:'equirements of the City of Anaheim along La Palma Avenue and Anaheim Road, su.ch as curbs and gutters, sidel-ralks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Eneineer, and that said engineering re- q'drements or improvements be installed at the time the property is developed. 3. 'rhat the ONTlers of sllbject Rroperty pay to the 8ity of Anaheim the SlJm of ~2.00 per front foot on both La Palma Avenue and Anaheim Road for street lighting purposes, said amount to be paid at the time said property is developed. 'rhat the owners of subject property place of record standard City of Anaheim M-l Deed Restrictions, approved by the City Attorney. 6. That Conditions No. 1 and 5 above mentioned be complied with within a period of 90 days from date hereof, or such further time as the Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the Oi ty Council an amendment to Article IX, Chapter 2 of the Anaheim Hunicipal Code to amend said Anaheim l1unicipal Code to accomplish the object herein found and determined to be necessary and proper.
