OF ANAHEIM GRANTING VARIANCE NO, 1822
WHEREAS, the City•PZannin9 Commission of the City of
Anaheim did receive a petition for zoning variance from
W. H. Jewett owner
RESOLUTION NO. 66R -638
O
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
That portion of Lot 5 of Tract 71, in the City of
Anaheim, County of Orange, State of California, as per
map recorded in Book 10, page 22 of Miscellaneous
Maps, in the office of the County Recorder of said
County, described as follows:
Beginning at the center line intersection of Katella
Avenue and Placentia Avenue, said point being the
northwest corner of Lot 5 of Tract No. 71 in Book 10,
page 22 of Miscellaneous Maps, Records of Orange
County, California, thence South 89° 45' 20" East
along the center line of Katella Avenue 196.00 feet
to a point; thence South 0° 07' 50" West 60.00 feet
to the true point of beginning; thence continuing
South 0° 07' 50" West 150.00 feet to a point; thence
North 89° 45' 20" West 143.00 feet to a point on the
East right of way of Placentia Avenue; thence
North 0° 07' 50" East parallel to the center line of
Placentia Avenue 130.00 feet to an angle point;
thence North 45° 11' 15" East to a point on the
South right of way of Katella Avenue; thence
South 89° 45' 20" East parallel to the center line
of Katella Avenue 123.00 feet to the true point of
beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on August 29, 1966 notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18,76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No -63 S
recommending that Variance No. 1822 be denied
and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting the
action of the City Planning Commission denying said
variance, and said appeal was set for public hearing on

i+es duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration- of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
14. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the same
is hereby granted permitting waivers of the following Anaheim
Municipal Code limitations:
(1) Maximum area of free- standing signs
(Section 18.62.100(b -1));
(2) Maximum number of free standing signs
(Section 18.62.090(B -1));
(3) Minimum distance between free standing signs
(Section 18.62.090(B
on the property hereinbefore described, subject to the following
conditions.
1. That reasonable landscaping shall be provided on
subject property in accordance with City of Anaheim
Service Station Minimum Site Development Standards,
as indicated on the plans, prior to final building
inspection.
2. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. 1
and 2.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner
his heirs, successors or assigns, to comply with the
Anaheim Municipal Code and regulations and the conditions
herein. Said variance is granted for the term prescribed by
the Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by
