A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 872
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from Eldon Kanegae, 1800 Sandalwood Lane, Newport Beach,
California, to establish a beer bar in a shopping center on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
That portion of the Northeast quarter of the Northwest
quarter of Section 13, in Township 4 South, Range 11 West,
in the Rancho Los Coyotes, City of Anaheim, as shown on a
map thereof recorded in Book 51, page 11 of Miscellaneous
Maps, in the office of the County Recorder of said County,
described as follows:
Beginning at a point in the North line of said Northwest
quarter, distant thereon South 89° 41' 15" West 201.66 feet,
from the Northeast corner of said Northwest quarter, and
running thence South 0 12,' 20" East parallel with the East
line of the land described on page 2 of that certain decree
recorded October 15, 1963 in Book 6762, page 263, Official
Records, which land is also shown on a Map of Survey
recorded in Book 74, page 5, of Record of Surveys, in the
office of the County Recorder of said Orange County,
66 feet, to the South line of the North 66 feet of said
Northwest quarter, and the true point of beginning of the
boundary of the land described herein; thence continuing
South 0° 12' 20" East along said parallel line 236.55 feet;
thence North 89° 41' 15" East, parallel with the North line
of said Northwest quarter 201.61 feet to a point in the
East line of said Northwest quarter; thence
North 0° 11' 45" West, along the East line of said Northwest
quarter 111.55 feet, more or less to a point in the South
line of the North 191 feet of said Northwest quarter; thence
South 89 41' 15" West, parallel with the North line of
said Northwest quarter, 170.00 feet, to a point in the West
line of the East 170.00 feet of said Northwest quarter;
thence North 0° 12' 20" West parallel with the East line of
the land described in said decree 125 feet to the South line
of the North 66 feet of said Northwest quarter; thence
South 89° 41' 15" West along said South line 31.66 feet
to the true point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on A 15 19 66 notices of
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. p(' 66 -51l Sax444
granting Conditiofial Use Permit No. 872,

and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to iew the action of the
City Planning Commission in granting said Conditional Use
Permit and did thereupon fix the 27tfi day of se tember
19_66 as the time and the Council Chamber in the City Hall
of tthe of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law nd the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time :-.nd place fixed for said public
hearing, the City Council did duly hold and conduct'such hear-
ing and did give ;,11 persons interested therein n opportunity.
to be heard .,nd did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommend:: tions of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
An,:.heim Munic ip. =:1 Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the :.re_ in which it is proposed to be loc ted.
The size and shape of the site proposed for the
use is adequate to -)low, the full_development of
the proposed use in a manner not detrJ.tnental to the
particular are nor to the peace, he lth, safety
and general welfare.
The traffic generated by the proposed use will not
impose an undue burden upon to e...s Bets and high-
ways designed and improved to carry the tr: f f is in
the area.
5. The granting of the Condition a1 Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and gener.1 welf-re of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission gra nting sid Conditional Use Permit be, and the
same is hereby sustained and tht Condition Use Permit
No. 872 be, :.nd the same is hereby, granted permitting
the establishment of a beer bar in a shopping center on the
property hereinbefore described, subject to the following
condition:
That subject property shall be developed
substantially in accordance with plans and
specifications on file with the City of
Anaheim, marked Exhibits Nos. 1 and 2.
The City Council hereby reserves the right to
revoke such Conditional Use Permit for good cause or
failure of said owner his heirs, successors
or assigns to comply with the Anaheim Municipal Code and
regulations and the condition(s) herein.
THE FOREGOING RESOLUTION is approved and signed
