A RESOLUTION 01' THE CITY COUNCIL OF THE CITY OF ANAHEIM
DENYING VARIANCE NOo 1098.

WHEREAS, the City Planning Commission of the City of Anaheim
did receive a petition for zoning variance from Dr. Franz Pohl.
the owner of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as follows~
Lot 28 of Tract No. 1194, in the City of Anaheim,
as shown on a map thereof recorded in Book 38,
Pages 1 and 2, Miscellaneous Maps, records of said
Orange County.
(Said property is located at 883 South Los Angeles
Street.)
AND WHEREAS, the City Planning Commission did hold a public
hearing at the City Hall in the City of Anaheim on ~il h ,
19 59 , notices of which said public hearing weredU1y given as re=
quired by law and the provisions of Section 9200.17 of the Anaheim
Municipal Code~ and
WHEREAS, said City Planning Commission, after due inspection,
investigation and studies made by itself and in its behalf9 and after
due consideration of all evidence and reports offered at said hearing,
did adopt Resolution No. 187 Series 19~8-~9 , rA~ommAnding ~naT.
Variance No. 1098 be granted for Addition No.1 only , and
WHEREAS, thereafter, within twenty (20) days from the date of
the adoption of said resolution, a written appeal was filed with the
City Council of the City of Anaheim protesting the action of the City
Planning Commission granting said variance, and said appeal was
set for public hearing on Mav 12 , 19 ~g , at 7~OO
o'clock P.Mo at the City Hall in the City of Anaheim, and notice of
such public hearing was duly given as required by law and the provi-
sions of Section 9200017 of the Anaheim Municipal Code, and
WHEREAS, after due investigation and studies made by itself
and in its behalf, and after due consideration of all the evidence and
reports offered at said hearing, the City Council does find and de=

10 There is no substantial property right possessed by
other property in the same vicinity and zone and denied
the subject property.
20 It appears that the subject property can be adequately
developed and used under the present zoneo

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission granting
Variance No. 1098 to Dr. Franz Pohl, 900 South Walnut Street, Anaheim,
California to enlarge the existing rest home on the property hereinabove
described, be and the same is hereby disapproved, and the Variance No.
1098, be, and the same is hereby, denied.
THE FOREGOING RESOLUTION is approved and signed by me this
