A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING SPECIAL USE PERMIT NO.
28 TO REVEREND JAMES HEAPS TO CONVERT AN EXIST-
ING WAREHOUSE FOR USE AS A CHURCH AT ,9372 ORANGE
AVENUE, ANAHEIM, CALIFORNIA.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application from Reverend James Heaps,
1604 South Medina Drive, Anaheim, California, for a Special Use
Permit to convert an existing warehouse for use as a church on
the following described property situated in the City of Anaheim,
County of Orange, State of California:
Lot 20 of Tract No. 796, as shown ona map recorded
in Book 24, Page 28 of Miscellaneous Maps, Records
of Orange County, California.
EXCEPT the interest in the West 30 feet of said
land which was conveyed to the County of Orange for
highway purposes by deed recorded December 17, 1937
in Book '18, Page 43.5, Official Records,
ALSO: Lot 21 of Tract No. 796, as shown on a map
recorded in Book 24, Page 28 of Miscellaneous Maps,
Records of Orange County, California.
EXCEPT the West 10 feet thereof for road purposes
only.
(Said property is located at 9372 Orange Avenue,
Anaheim, California.)
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on March 16, 19.59, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and

WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. 184 -- Series 19.58-.59,
granting Special Use Permit No. 28, upon the conditions therein
set forth; and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission in granting said
Special Use Permit, and said appeal was set for public hearing
on April 21, 19.59 at 7:00 o'clock P.M. at the City Hall in the
City of Anaheim, and notice of such public hearing was duly
given as required by law and the prOVisions of Section 9200.17
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports; and

WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that said
Special Use Permit should be granted upon the terms and conditions
hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission granting said Special Use Permit, be, and the same is
hereby approved, and that Special Use Permit No. 28, be, and the
same is hereby, granted to Reverend James Heaps, 1604 South
Medina Drive, Anaheim, California, to convert an existing ware-
house for use as a church on the property hereinabove described,
upon the following conditions:
1. That the building be improved in conformance with
renderings presented to the City Council and on
file with the City of Anaheim, which improvements
shall include completely repainting the outside
of the building.
2. That the owner of subject property deed to the City
of Anaheim a strip of land 32 feet in width from
the center line of the street along Orange Avenue,
and a strip of land 32 feet in width from the center
line of the street along Webster Street, for street
widening purposes.
3. That all engineering requirements of the City of
Anaheim, along Orange Avenue and Webster Street,
such as curbs and gutters, sidewalks, street grading
and paving, drainage facilities or other pertinent
work be complied with as required by the City Engi-
neer, and in accordance with plans and specifications
on file in the office of said City Engineer.
4. That the owner of subject property pay to the City
of Anaheim the sum of $2.00 per front foot along
Orange Avenue and Webster Street, for street light-
ing purposes.
The City Council hereby reserves the right to revoke
such Special Use Permit for good cause or failure of said owner,
his heirs, successors or assigns to comply with the Anaheim
Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 21st day of April, 1959.
