RESOLUTION NO. 5097
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING AND APPROVING THE
EXECUTION OF AN AGREEMENT WITH SOUTHERN PACIFIC
COMPANY GRANTING TO THE CITY PERMISSION TO
INSTALL A lO-INCH WATER PIPE BENEATH THE PROPERTY
AND TRACKS OF SOUTHERN PACIFIC COMPANY BETWEEN
SAID COMPANY'S STATIONS OF WEST ANAHEIM AND
STANTON, CROSSING THE CENTER LINE OF SOUTHERN
PACIFIC COMPANY'S TRACKS AT ENGINEER STATION

WHEREAS, the Southern Pacific Company, a corporation
of the State of Delaware, has tendered to the City of Anaheim
an Indenture granting to the City of Anaheim subject to the
terms, covenants and conditions therein contained, the right to
construct, reconstruct, maintain and operate a 10-inch water
pipe within an IS-inch casing, beneath the tracks and property
of the Southern Pacific Company between said Companyts Stations
of West Anaheim and Stanton, in the County of Orange, State of
California, crossing the center line of the Southern Pacific
Companyts tracks at Engineer Station 110+81, in the location
shown in red on the print of said Companyts Los Angeles Division
Drawing A-5247, Sheet No.1, dated January 26, 1959, attached to
and made a part of the Indenture above mentioned; said pipe and
casing to be constructed and maintained in accordance with the
specifications indicated on the print of Drawing C. S. 1741 of
the Southern Pacific Company; and
WHEREAS, said grantor has tendered to the City of
Anaheim the Indenture above mentioned to be executed by said
Southern Pacific Company and the City of Anaheim, which Indenture
the City Council finds would be for the benefit and best interest
of the City of Anaheim and should be approved;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Indenture tendered to the City of
Anaheim by the Southern Pacific Company, a corporation of the
State of Delaware, granting to the City, but subject to the terms,
covenants and conditions therein contained, the right to construct,
reconstruct, maintain and operate a 10-inch water pipe enclosed
within an l8-inch casing, beneath the tracks and property of
Southern Pacific Company, in the County of Orange, State of
California, crossing the center line of Southern Pacific Company's
tracks at Engineer Station 110+81, as hereinabove more particu-
larly described, be, and the same is hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are, hereby authorized to execute said Indenture
above mentioned for and on behalf of the City of Anaheim.
BE IT FURTHER RESOLVED that the City Auditor of the
City of Anaheim be, and he is, hereby authorized to pay to the
Southern Pacific Company the sum of Fifty Dollars ($50.00).
