A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 867
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a conditional use permit from
Herbert C. Newsom and Phyllis L. Newsom, et al., 2172 Cerritos
Avenue, Anaheim, California, to establish a service station
within 75 feet of an R -1, One Family Residential Zone, on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
Lots 1 and 2 and the North 21.03 feet of lot 3,
all of Tract No. 2015, in the City of Anaheim,
County of Orange, State of California, as per
map recorded in book 58 page 16 of Miscellaneous
Maps, in the office of the County Recorder of
said County.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of. Anaheim upon
said request on August 1 19 66 notices of which said
public hearing were duly given as required by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. PC66 -35
granting Conditional Use Permit No. 867, subiect to
certain conditions therein set forth and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in granting said conditional use
permit and did thereupon fix the 6th day of ptemb r
1966 as the time and the Council Chamber in the C Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 867 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion grantinq Conditional Use. Permit No. 867 be, and the
same is hereby disapproved and that the request of
Herbert C. Newsom and Phyllis L. Newsom, et al., for a conditional
use permit to establish a service station within 75 feet of an
R -1, One Family Residential Zone, on the property hereinbefore
described, be, and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 6th day of September 19 66
