66-564RESOLUTION NO. 66R -564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 863 WHEREAS, the City Planning Commission of'the City of Anaheim did receive a request for a conditional use permit from Grenville Pascal Brooks and Bonnie Jean Brooks, 3341 W. Ball Road, Anaheim, California; Joseph A. Seymour and Frances L. Seymour, 3347 W. Ball Road, Anaheim, California; and Arnold D. Heth and Irene Heth, 3351 W. Bali Road, Anaheim, California, to permit office use of existing residential structures and a waiver of the minimum site area (Section 18.38.050(1 -a) of the Anaheim Municipal Code), on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Lots 1, 2 and 3 of Tract No. 2839, as per map recorded in Book 85, Pages 9 to 15, both inclusive, of Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of upon said request on .T, 1 1R 1966 notices of which said public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. P. r_ 66 -24, denying Conditional Use Permit No. 861 and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in s1a ing said conditional use permit and did thereupon fix the thfh day of t 19 66 as the time and the Council Chamber in the City H all of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 863 should be denied. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Conditional Use Permit No. 863 be, and the same is hereby sustained and that the request of the petitioners hereinabove named for a conditional use permit allowing office use of the existing residential structures and a waiver of the minimum site area requirement (Section 18.38.050 (1 -a) of the Anaheim Municipal Code), on the property hereinbefore described, be, and the same is hereby denied.
