66-483WHEREAS, the City Council did heretofore, to wit, on
November 14, 1961, adopt Resolution No. 7353 in Reclassification
Proceedings Nos. 60 -61 -96 and 61 -62 -30 finding and determining
that the property and area therein described should be changed
from R -1, ONE- FAMILY RESIDENTIAL ZONE to C -1, NEIGHBORIOOD-
COMMERCIAL ZONE, subject to certain conditions set forth in said
resolution; and
follows:

A RESOLUTION OF THE CITY COUNCIL OF ThE
CITY OF ANAHEI:I AHENDING RESOLUTION NO.
7353 IN RECLASSIFICATION PROCEEDINGS NOS.

WHEREAS, Condition No. 2 of said resolution reads as
"2. Recordation of C -1, NEIGHBORHOOD- COii4ERCIA.L ZONE,
Deed Restrictions limiting the use of subject
property to business and professional offices
only and limiting the height of any structures
to one story."
AND WHEREAS, a number of the owners of subject property
have requested that permission be granted for the removal of
said deed restrictions; and
WHEREAS, said requests were set for public hearings
before the City Planning Commission and City Council, and notice
thereof properly given according to law, and said hearings were
duly held; and
WHEREAS, the City Council finds that most of the uses
permitted in the C -1 Zone at the time Resolution No. 7353 was
adopted, that were objectionable for this particular area, have
since been removed from the C -1 Zone uses, and that Resolution
No. 7353 should, therefore, be amended to provide that if the
existing residential structures on subject property are removed
prior to development, Condition No. 2 of said resolution shall
not apply.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 7353 in Reclassification
Proceedings Nos. 60 -61 -96 and 61 -62 -30 be, and the same is
hereby amended by amending Condition No. 2 thereof to read as
follows:
"2. Recordation of C -1, GENERAL COMMERCIAL ZONE,
Deed Restrictions limiting the use of subject
property to business and professional offices
only and limiting the height of any structures
to one story; provided, however, that if the
existing residential structures located on
subject property are removed prior to develop-
ment, this condition shall not apply."
BE IT FURTHER RESOLVED that in all other respects saiu
Resolution No. 7353 be, and remain in full force and effect.
