A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF A COOPERATIVE AGREEMENT
BETWEEN THE STATE OF CALIFORNIA, ORANGE
COUNTY FLOOD CONTROL DISTRICT AND THE CITY
OF ANAHEIM, WITH REFERENCE TO THE CONSTRUC-
TION OF A STORM DRAINAGE CHANNEL BETWEEN THE
SANTA ANA RIVER AT BALL ROAD AND MIRALOMA
AVENUE.
WHEREAS, the State of California, acting by and through
its Transportation Agency, Department of Public Works, Division
of Highways, proposes to construct as a freeway, on new align-
ment, State Road 07- ORA -57- 10.9/22.0, between the Santa Ana
Freeway (Route 5) and the Los Angeles /Orange County Line; and
WHEREAS, there exists an unsatisfactory drainage
condition in the City of Anaheim between Ball Road and Miraloma
Avenue, which has resulted in frequent and periodic flooding of
public streets; and
WHEREAS, drainage waters approach the freeway from
the east in sheet flow and the State plans to construct ditches
on each side of the freeway connected by culverts for collect-
ing water and dispersing the water in sheet flow; and
WHEREAS, the State has acquired certain rights of way
for said freeway construction including sufficient width for
side ditches; and
WHEREAS, Orange County Flood Control District and the
City have proposed construction of a storm drainage channel
along the east side of the freeway between the Santa Ana River
at Ball Road and Miraloma Avenue consisting of an open collector
channel and reinforced concrete box culverts at roadway cross-
ings to convey storm runoff to the Santa Ana River, said storm
drainage channel hereinafter referred to as "Channel and
WHEREAS, construction of the Channel pursuant to the
April, 1964 report of said Flood Control District, entitled
"An Inventory of Flood Control and Water Conservation Deficien-
cies in Orange County, California," will eliminate the need for
certain culverts and the proposed side ditches in the State's
freeway; and
WHEREAS, Orange County Flood Control District has
prepared an Engineer's Report for bonding purposes and antici-
pates presentation of said report for the approval of said
District's voters during the calendar year 1966; and
WHEREAS, a successful election would provide funds
for all construction costs of said Channel over and above the
savings to the State in freeway drainage construction; but in
the event of no election or an unsuccessful election, said
Flood Control District and the City are willing to jointly
finance all construction costs of said Channel over and above
said savings to the State; and

WHEREAS, the Orange County Flood Control- District
and the City will benefit from said construction of the Channel
through the improvement of drainage conditions on public roads
and on- private property, and the extent.of-their participation
in the construction of the drainage facilities referred to herein
is reasonably proportioned to said benefit; and
WHEREAS, the State will benefit from said Channel
construction'throrugh the elimination of certain drainage struc-
tures and side ditch construction on the State freeway, and the
extent of the State's participation in the construction of the
Channel referred to herein is reasonably proportioned to said
benefits; and
WHEREAS the State, the Flood Control District, and
the City do mutually desire to cooperate and jointly participate
in the construction of said Channel which will improve the
aforesaid unsatisfactory drainage condition, and desire to enter
into an agreement specifying the portions of the cost, and to
provide for the future maintenance of said Channel; and
WHEREAS, the State has submitted to the City such
cooperative form of agreement Agreement No. 1962 to be
made and entered into between the parties, which agreement the
City Council finds would _be_in the best interests of the City
and should be approved.
NOW THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement, designated "Agreement
No. 1962," submitted to the City by the State of California,
Department of Public Works, Division of Highways, to be made and
entered into between the City of Anaheim, Orange County Flood
Control District and the State of California, providing for the
joint participation in the construction of a storm drainage
channel along the east side of the proposed State Route 57 Freeway,
from the Santa Ana River at Ball Road to Miraloma Avenue, speci-
fying the portions of the cost§ and providing for the future
maintenance of said channel, be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 28th day of June, 1966.
