RESOLUTION NO. 5059.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUI-
SITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL
PURFOSES.
WHEREAS, PAUL D. TEDRICK and MARIAN TEDRICK, husband
and wife are the owners of the hereinafter described real
property situated in the City of Anaheim, County of Orange,
State of California; and
WHEREAS, said owners have offered to sell said property
to the City of Anaheim for the sum of $3,500.00 cash, lawful
money of the United States; and
WHEREAS, the City Council does find and determine that
public convenience and necessity require the purchase and acqui-
sition of said parcel of real property for municipal purposes,
and that the price which the owners thereof are willing to
accept is reasonable and not out of proportion to the fair market
value of said property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of PAUL D. TEDRICK and MARIAN
TEDRICK, husband and wife, to sell all that certain real property
situated in the City of Anaheim, County of Orange, State of
California, described as follows, to wit:
That portion of Lot 25 of Anaheim ExtenSion, in the
City of Anaheim, as shown on a map of survey made by
William Ha~mel and filed in the office of the County
Recorder of Los Angeles County, California, a copy of
which is recorded in Book 3, Page 163, et seq., en-
titled Los Angeles County Maps, in the office of the
County Recorder of said Orange County, described as
follows:

Beginning at the Southwest corner of Lot 25 of Anaheim
Extension, (which for the purpose of this description,
is construed to be the center line intersection of
Los Angeles Street and Ball Road), as shown on a map
made by William Hamel and filed for record in the office
of the County Recorder, Los Angeles, California; thence
North 150 30' West along the West line of said Lot 25,
a distance of 153.86 feet; thence Easterly parallel
with the South line of said Lot 25, 54.99 feet; thence
South 150 301 East, a distance of 87.46 feet to a
point, said point being the beginning of a curve concave
Northeasterly and having a radius of 15.00 feet; thence
Southerly and Easterly alon~ said curve through a
central angle of 740 33' 13 , an arc distance of 19.52
feet to a point in a line parallel with and 53.00 feet
Northerly of the South line of said Lot 25; thence
Easterly along the last mentioned parallel line to the
Easterly line of the land conveyed to Paul D. Tedrick,
et ux., in deed recorded December 20, 1938, in Book
972, Page 428, Official Records, in the office of the
County Recorder of said Orange County; thence Southerly
along a line parallel with the West line of said Lot
25, to the South line of said Lot 25, thence Westerly

along the South line of said Lot 25, to the point of
beginning;

EXCEPTING THEREFROM that portion of said land within
Ball Road and Los Angeles Street, as now established.
for the sum of $3,500.00 cash, lawful money of the United States,
be, and the same is hereby accepted, subject to the following
conditions:
1. That subject property shall be conveyed to the
City of Anaheim free and clear of all encumbrances
except the second half of the general and special
taxes for the fiscal year 1958-59 including any
special district levies, payments for which are
included therein and collected therewith; and cove-
nants, conditions, restrictions, reservations,
rights, rights of way and easements of record.
2. That the purchase of this property is contingent
upon the completion of Escrow No. 209-7814 filed
concurrently herewith with Bank of America National
Trust and Savings Association in which David S.
Collins and Marion Graaf Collins are deeding to
Paul D. Tedrick and Marian Tedrick certain real
property.
BE IT FURTHER RESOLVED that the City Manager of the
City of Anaheim be, and he is hereby, authorized for and on behalf
of the City of Anaheim to sign escrow instructions for the purchase
of said real property, and to enter into an escrow with the owners
of said property at Bank of America National Trust and Savings
Association, Anaheim Branch, 150 E. Center Street, Anaheim,
California.
BE IT FURTHER RESOLVED that the City Auditor be, and he
is hereby, authorized to deposit in escrow at Bank of America
National Trust and Savings Association, Anaheim Branch, 150 E.
Center Street, Anaheim, California, the sum of $3,500.00 cash,
lawful money of the United States, to be paid to PAUL D. TEDRICK
and MARIAN TEDRICK when a deed conveying said property to the City
of Anaheim, free and clear of all encumbrances, except as herein-
above set forth, can be recorded and a policy of title insurance
issued by Security Title Insurance Company, 825 North Broadway,
Santa Ana, California, showing said property vested in the City
of Anaheim free and clear of all encumbrances, except as herein-
above specified.
BE IT FURTHER RESOLVED that the City of Anaheim shall
pay all charges in connection with the purchase of this property
including charges for furnishing a policy of title insurance
necessary to show title vested in the City of Anaheim, as herein
provided, as well as all charges in connection with Escrow No.
209-7814 filed concurrently herewith with Bank of America National
Trust and Savings Association in which David S. Collins and Marion
Graaf Collins are deeding to Paul D. Tedrick and Marian Tedrick
certain real property.

this 24th day of February, 1959.
