A RESoLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTI~G SEALED PROPOSAL
AND AWARDING CO~fRACT TO THE LOWEST RES-
PONSIBLE BIDDER FOR THE FURNISHING TO THE
CI'l.'Y OF ANAHEIM OF CAST IRON WATER PIPE
AND FITTINGS.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to wit:
the Anaheim Gazette, on the 29th day of January, 1959, and the
5th day of February, 1959, a notice inviting sealed proposals
for the furnishing to the City of Anaheim, in approximate quan-
tities, of the following cast iron water pipe and fittings:
ITEr'! I 2,000 feet of 6-inch cast iron pipe;
ITEM II 16,000 feet of 8-inch cast iron pipe;
rTEH III 30,000 feet of la-inch cast iron pipe;
IIIIEl'-i IV 35,000 feet of 12-inch cast iron pipe;
ITEM V 100,000 pounds of cast iron fittings.
AlVD WHEREAS, said notice did provide that said pipe
and fittings shall be in accordance with "Specifications for
Cast Iron Water Pipe, Series of 1959 - City of Anaheim"; and
WHEREAS, such notice inviting proposals for said
cast iron water pipe and fittings did provide that said
sealed proposals would be received by the City of Anaheim
at the office of the City Clerk of said City up to the hour
of 2:00 o'clock P.M. on February 11, 1959, for the furnishing
to said City of said water pipe and fittings, and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals prior to 2:00 o'clock P.M. on February
11, 1959, for the furnishing of said cast iron water pipe and
fittings, which proposals were opened on said date at the hour
of 2:00 o'clock P.M., in public, in the City Council Chambers
in the City hall, in the City of Anaheim, by the City Clerk
and the Director of Public Utilities, and duly tabulated by
the Director of Public Utilities and t~l,resu~~ thereof re-
ported to the City Council at its nex~~~~~meeting, for
action thereon by said City Council. That sealed proposals
were received from the following persons, firms or corporations
in the amounts set forth:

AND WHEREAS, the City Council does rind that the
sealed proposal of the PACIFIC STATES CAST IRON PIPE CO., 6399
Wilshire Boulevard, Los Angeles 48, California, is the lowest
responsible bid for the rurni~hing of cast iron water pipe and
fittings specified in Items I, II, III, IV and V of the notice
inviting sealed proposals and in accordance with the specifica-
tions set forth in said notice inviting sealed proposals, and
that said proposal of the Pacific States Cast Iron Pipe Co.
should be accepted and a contract awarded to said company for
furnishing said pipe and fittings to the City of Anaheim;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said proposal submitted by the
Paciric States Cast Iron Pipe Co. for the furnishing of cast
iron water pipe and fittings, as specified in the notice
inviting sealed proposals therefor and in accordance with and
conformity to "Specifications for Cast Iron Water Pipe, Series
of 1959, City of Anaheim," be, and the same is hereby, accepted
and that a contract for the furnishing of said water pipe and
fittings be, and the same is hereby, awarded to said Pacific
States Cast Iron Pipe Co.; and
BE IT FURTHER RESULVED that the award of a contract
to said Pacific States Cast Iron Pipe Co. is declared to be
ror the approximate quantities set forth in the notice inviting
sealed proposals and that the actual amounts required by the
City may be more or less than these amounts; and
BE IT FURTHER RESuLVED that said Pacific States Cast
Iron Pipe Co., be, and it is hereby required to execute a
contract, in required form satisfactory to the City of Anaheim
and upon the terms and conditions speciried in the notice invit-
ing sealed proposals and the proposal submitted by it, and in
accordance with the specifications for cast iron water pipe and
fittings as set forth in said notice inviting sealed proposals
for the furnishing of said cast iron water pipe and fittings
hereinabove more particularly set forth, in all required lengths,
at the prices as follows:

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, accepted
and said contract awarded for the above prices for said cast iron
pipe and fittings, F.O.B. the mill with freight allowance to Ana-
heim, said pipe and fittings to be delivered as required by the
City of Anaheim; PROVIDED, HuWEVER, that said prices shall be and
remain in effect only for such pipe as is shipped on or before
July 1, 1959, and that for pipe Shipped after July 1, 1959, the
price may be increased, should there be an increase in the price of
Pig Iron, but not to exceed an increase of $6.00 per ton. The inc-
rease allowance shall not apply to fittings but the price hereinabove
set forth for fittings shall apply to all fittings shipped.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and
directed to execute for and on hehalf of the City of Anaheim with
said Pacific States Cast Iron Pipe Co., a written contract for the
furnishing of said cast iron water pipe and fittings hereinabove
set forth and in accordance with the specifications for cast iron
water pipe, series of 1959, City of Anaheim, the notice inviting
sealed proposals and the terms of this resolution, and the contract
approved by the City Attorney of the City of Anaheim, and
BE IT FURTHER RESOLVED that said contract shall contain
a provision that should said Pacific States Cast Iron Pipe Co. fail
or neglect to furnish said cast iron pipe and/or fittings in accord-
anoe with said speoifioations and the sealed proposal submitted by
it and accepted by the City as herein specified, it shall, in addi-
tion to any other penalties provided in the oontract documents, be
liable to t~e City of Anaheim for all loss or damage that the latter
may suffer on account thereof.
