RESOLUT ION NO. 5024
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT A
CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2
OF THE ANAHEIM MUNICI PAL CODE SHOULD BE AMENDED
TO ACCOMPL I SH SAID CHANGE OF ZONE.
WHEREAS, the City Planning Commission ot the City of
Anaheim did heretofore fix a time and place for the holding of
a public hearing upon a proposed change in the boundaries of
the zone or zones hereinafter mentioned and described in the
manner and as prescribed in Article IX, Chapter 2 of the
Anaheim Municipal Code, and did duly hold and conduct such
public hearing to consider said proposed change of zone or
zones, and did receive evidence and reports from persons inter-
ested therein; and
WHEREAS, within a period of forty (40) days following
the final hearing thereon, the Planning Commission did refer
the matter of said proposed change of zone or zones to the City
Council without recommendation, due to the fact that a motion
to approve said change of zone failed to carry by a two-thirds
vote of the members of said Commission; and
WHEREAS, upon receipt of the report and findings
of the City Planning Commission, the City Council did thereupon
fix the 27th day of January, 1959, as the time and the Council
Chamber in the City Hall of the City of Anaheim as the place for
a public hearing upon said proposed change of zone, and did
give notice thereof in the manner and as provided in said Article
IX, Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said publiC
hearing, the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find and determine
that the property and area proposed to be changed from the zone
in which it is now situated to a different zone, as hereinafter
set forth, is more suitable for the zone or zones to which it
is proposed to change said property and area and that the in-
clusion of said property and area in such new zone or zones
will increase the value of said property and area and will not
depreciate the values of property in adjoining zones.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all of the property and area situated
in the City of Anaheim, County of Orange, State of California,
described as fol1o~, to wit:

That portion of Lot 13 of Anaheim Extension, in the
City of Anaheim, County of Orange, State of California,
as per map made by William Hamel and filed in the
office of the County Recorder of Los Angeles County,
California, described as follows:
Beginning in the center of Santa Ana Street extended
at a point 18.35 chains Easterly from East Street;

thence Easterly along said center line of Santa Ana
Street 6 chains; thence Southerly parallel tp East
Street 25 chains; thence Westerly 6 chains on the
middle line of South Street; thence Northerly paral-
lel to East Street 25 chains to the point of begin-
ning.
RESERVING THEREFROM the portion now occupied by Santa
Ana and South Streets.
be changed from R-O, RESIDENTIAL SUBURBAN ZONE to R-l, SINGLE-
FAMILY RESIDENTIAL ZONE, upon the following conditions:
1. That the lot size or area of the tier of lots
along Santa Ana Street, South Street and along
the west side of subject property, shall be limited
to a minimum of 8,000 square feet; and that the
houses to be constructed on said lots shall contain
a minimum livable floor space of 1,500 square feet.
2. That the lot size or area of the remainder of the
lots of the above described property shall be
limited to a minimum of 7,200 square feet; and
that the houses to be constructed on these lots
shall contain a minimum livable floor space of
1,350 square feet.
3. That the owners of subject property place of record
standard City of Anaheim R-l Deed Restrictions,
approved by the City Attorney, which restrictions
shall provide that the houses constructed on the
tier of lots along Santa Ana Street, South Street
and along the west side of the property shall
contain a minimum livable floor space of 1,500
square feet, and that the houses constructed on the
remainder of the lots of subject property shall
contain a minimum livable floor space of 1,350
square feet.
4. That the owners of subject property shall file a
tract map of said property; and that an ordinance
rezoning the above described property shall not
be adopted until a final tract map has been recorded.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to the
City Council an amendment to Article IX, Chapter 2 of the Anaheim
Municipal Code to amend said Anaheim Municipal Code to accomplish
the object herein found and determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of February, 1959.
