RESOLUTION NO. 5004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT A
CHANGE OF ZONE IS NECESSARY IN A CERTAIN AREA
OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2
OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED
TO ACCOMPLI SH SAID CHANGE OF ZONE; AND THAT A
CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CER-
TAIN AREA OF THE CITY HEREINAFTER DESCRIBED.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
declaring its intention to change the boundaries of one of the
zones hereinafter mentioned and described and recommending
denial of a change in the boundaries of one of said zones, and
did fix a time and place for the holding of a public hearing
on the proposed changes in the boundaries of said zones in the
manner and as prescribed in Article IX. Chapter 2 of the Anaheim
MUnicipal Code. and did duly hold and conduct such public hear-
ing to consider said proposed changes of zones. and did receive
evidence and reports from persons interested therein; and
WHEREAS. within a period of forty (40) days following
the final hearing thereon. the Planning Commission did duly
announce by formal resolution its findings of facts and declare
its opinions and reasons for recommending an amendment to said
Article IX, Chapter 2 of the Anaheim Municipal Code to effect
the proposed change in the boundaries of one of the zones herein-
after mentioned and described. and for recommending denial of a
change in the boundaries of one of said zones; and
WHEREAS. upon receipt of the report and recommendation
of the City Planning Commission. the City Council did thereupon
fix the 27th day of January, 1959. as the time and the Council
Chamber in the City Hall of the City of Anaheim as the place for
a public hearing upon said proposed changes of zones. and did
give notice thereof in the manner and as provided in said Article
IX. Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing. the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports. and
did thereupon consider the recommendations of the City Planning
Commiss ion; and
WHEREAS. the City Council does find and determine that
a portion of the property and area proposed to be changed from
the zone in which it is now situated to a different zone, as
hereinafter set forth, is more suitable for the zone to which it
is proposed to change said property and area and that the in-
clusion of said property and area in such new zone will increase
the value of said property and area and will not depreciate the
values of property in adjoining zones; and that a portion of
said property and area proposed to be changed from the zone in
which it is now situated to a different zone as hereinafter set
forth is more suitable for the zone in which it is now incorpo-
rated, and that such change of zone should not be granted.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Parcel No. 1 of the following described
property situated in the City of Anaheim, County of Orange,
State of California, to wit:
PARCEL 1:
Commencing at a point 33 feet distant from the center
line of East Vermont Avenue and 30 feet distant from
the center line of Placentia Avenue, the true point
of beginning; thence westerly along the northerly
right-of-way line of East Vermont Avenue a distance
of 135 feet; thence northerly parallel to South
Placentia Avenue a distance of 135 feet; thence easterly
parallel to East Vermont Avenue a distance of 135 feet;
thence southerly along the westerly right-of-way line
of South P1acentia Avenue a distance of 135 feet to the
true point of beginning.
PARCEL 2:
Commencing at a point 30 feet distant from the center
line of South Placentia Avenue and on the northerly
right-of-~~y line of East Vermont Avenue a distance
westerly of 135 feet which is the true point of begin-
ning; thence westerly along said right-of-way line a
distance of 70 feet; thence northerly at right angles
with East Vermont Avenue a distance of 132.83 feet,
thence easterly parallel to East Vermont Avenue a
distance of 105 feet, more or less; thence southerly
parallel to South Placentia Avenue a distance of 150
feet to the true point of beginning.

COMMERCIAL ZONE, subject to the conditions hereinafter set forth;
and that Parcel No.2, above described, shall remain in the R-3,
MULTIPLE-FAMILY RESIDENTIAL ZONE in which it is now incorporated,
and that its reclassification to C-l, NEIGHBORHOOD-COMMERCIAL
ZONE, be and the same is hereby denied.
That Parcel No.1, above described, shall be changed
from R-A, RESIDENTIAL-AGRICULTURAL ZONE to C-3, HEAVY-
COMMERCIAL ZONE,

upon the following conditions:
1. That the owner of subject property place of record
standard City of Anaheim C-3 Deed Restrictions,
approved by the City Attorney, which restrictions
shall limit the C-) uses of said property to a
service station only.
2. That the owner of subject property deed to the City
of Anaheim a strip of land 53 feet in width, from
the center line of the street, along Placentia
Avenue for street widening purposes.
3. That the owner of subject property pay to the City
of Anaheim the sum of $2.00 per front foot for
street lighting purposes.

4. That all of the above conditions shall be complied
with within a period of 90 days from date hereof,
or such further time as the Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be necessary
and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of January, 1959.
