RESOLUTION NO. 4958
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRA~TING SPECIAL USE
PERMIT NO. 2 TO JOHN SIMONE FOR A PERIOD
OF TWO YEARS TO ESTABLISH A HELICOPTER
SIGHTSEEING SERVICE ON THE PROPERTY
HEREINAFTER DESCRIBED.
WHEREAS, the City Planning Commission or the City or
Anaheim did receive an application rrom John Simone, 9771
Harriet Lane, Anaheim, Calirornia, ror a Conditional or
Special Use Permit to establish a helicopter sightseeing ser-
vice on the rollowing described property situated in the City
or Anaheim, County or Orange, State of California:
The South half or the East half of the
Southeast quarter or the Southeast
quarter of Section 11, Township 4 South,
Range 11 West, S.B.B.&M.
Excepting therefrom that portion or said
land included within the following:
That portion or the East half or the
Southeast quarter of the Southeast quarter
of Section 11, Township 4 South, Range 11
West, S.B.B.&M., included within a strip of
land 110 feet wide, lying 55 feet on each
side of the following described center line:
Beginning at the Southeast corner of said
Section 11, (the West line of Section 13 of
said Township and Range, bears South O. 09'
50" East, from said Southeast corner); thence
along the East line or said Section 11, (said
East line being also the center line of Stanton
Avenue, 60 feet wide, as declared by Action of
the Board of Su~ervi80rs of said County),
North O. 11' 10 West, a distance or 612.23
reet; thence Northerly along a curve concave
Westerly, tangent to the last described course
and having a radius of 2527.00 reet, through
an angle or 19. 58' 50", an arc distance of
881.23 reet;
ror the purpose of taking people on sightseeing rides; and

WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on December 1, 1958, notices or which said
public hearing were duly given as required by law and the
provisions of Section 9200.17 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, arter due inspection,
investigation and studies made by itself and in its behalf

and after due consideration of all evidence and reports
offered at said hearing, did adopt its Resolution No. 109,
Series 1958-1959, granting Conditional Use Permit No.2,
upon the conditions therein set forth; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in granting said Conditional
or Special Use Permit and did thereupon fix the 6th day of
January, 1959, as the time and the Council Chamber in the
City Hall of the City of Anaheim as the place for a public
hearing upon said Conditional or Special Use Permit, and
notice of such public hearing was duly given as required by
law and the provisions of Section 9200.17 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that said Conditional or Special Use Permit should
be granted upon the terms and conditions hereinafter set
forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting a Conditional or Special Use Permit to
John Simone to establish a helicopter sightseeing service on
the property hereinabove described, be and the same is hereby
approved, and that SPECIAL USE PERMIT NO. 2 be, and the same
is hereby, granted to said JOHN SIMO~E, 9771 HARRIET LANE,
ANAHEIM, CALIFORNIA, granting permission to establish a
helicopter sightseeing service on said property hereinabove
described, for the purpose of taking people on sightseeing
rides, upon the following conditions:
1. That the landing circle area shall be not less
than 250 feet from either Stanton or Lincoln
Avenue.
2. That adequate dust control shall be maintained
in the landing area.
3. That the helicopters used in the operation of
said sightseeing service shall not exceed 210
horsepower.

4. That no helicopters shall be stored on the
property when not in use.
5. That there shall be no night flights in the
operation of said sightseeing service.
6. That adequate oEf-street parking shall be
provided for customers.

7. That a 30-inch wire mesh fence shall be
constructed around the landing area.
8. That said Special Use Permit No.2 is
granted for a period of two years from
date hereof, but shall be subject to re-
view at the expiration of ODe year or
upon the receipt by the city of a sub-
stantial number of complaints from resi-
dents in the area.
The City Council hereby reserves the right to re-
voke such Special Use Permit for good cause or failure of
said owner, his heirs, successors or assigns to comply with
the Anaheim Municipal Code and regulations and the eonditions
herein.
THE FOREGOI~G RESOLUTION is approved and signed by me
this 6th day of January, 1959.
