A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AS
THE SUCCESSOR AGENCY TO THE ANAHEIM REDEVELOPMENT
AGENCY DECLARING CERTAIN PROPERTIES TO BE "EXEMPT SURPLUS
LAND" PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION
54221(f)(1)
WHEREAS, the Surplus Land Act, codified in California Government Code sections
54220, et seq. ("SLA"), defines "surplus land" as land owned in fee simple by any local agency
for which the local agency's governing body takes formal action in a regular public meeting
declaring that the land is surplus and is not necessary for the agency's use; and
WHEREAS, effective January 1, 2020, Assembly Bill (AB) 1486, and most recently
amended by Senate Bill (SB) 747 and Assembly Bill (AB) 480, effective January 1, 2024,
amended the SLA to require the City of Anaheim as the Successor Agency to the Anaheim
Redevelopment Agency ("Successor Agency") to formally declare properties as "surplus land" or
"exempt surplus land" prior to taking action to dispose of such properties; and
WHEREAS, a declaration of "exempt surplus land," as permitted by the SLA, is a process
adopted in State law; and
WHEREAS, pursuant to California Government Code section 5422 1 (f)(1)(B) of the SLA,
"exempt surplus land" includes, "Surplus land that is less than one-half acre in area and is not
contiguous to land owned by a state or local agency that is used for open -space or low- and
moderate -income housing purposes."; and
WHEREAS, pursuant to California Government Code section 54221(0(1)(D) of the
SLA, "exempt surplus land" includes, "Surplus land that a local agency is transferring to another
local, state, or federal agency, or to a third -parry intermediary for future dedication for the
receiving agency's use, or to a federally recognized California Indian tribe."; and
WHEREAS, pursuant to California Government Code section 54221(f)(1)(E) of the SLA,
"exempt surplus land" includes, "Surplus land that is a former street, right of way, or easement,
and is conveyed to an owner of an adjacent property.' ; and
WHEREAS, as required by the Redevelopment Agency Dissolution Act, the Successor
Agency prepared and received approval for the California Department of Finance ("DOF") of a
Long -Range Property Management Plan ("LRPMP") pursuant to Health and Safety Code Section
34191.1, which identified certain properties to be retained by the City "for future development"
purposes; and
WHEREAS, the Successor Agency owns sixty-three (63) properties located in the City of
Anaheim, and identified in Exhibit A, that are not needed for the Successor Agency's use, but
qualify as "exempt surplus land" for the reasons set forth in Exhibit A to this Resolution, which is
incorporated herein by this reference; and
WHEREAS, this declaration of "exempt surplus land" does not obligate the Successor
Agency to subsequently dispose of the land and the Successor Agency may in the future determine
that these properties are necessary for its use and not move forward with any disposition of any
specific property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANAHEIM, SERVING AS AND ON BEHALF OF THE SUCCESSOR AGENCY TO THE
ANAHEIM REDEVELOPMENT AGENCY, AS FOLLOWS:
The City Council hereby finds and determines that the foregoing recitals are true and
correct and are a substantive part of this Resolution.
2. Based on the above recitals and its independent review of Exhibit A, the City Council
hereby declares the properties listed in Exhibit A to be "exempt surplus land" for the
reasons set forth in Exhibit A.
3. The City Council finds and determines that this action results in no binding commitment
to authorize or advance the disposition of the "exempt surplus land"; will not result in a
direct or indirect physical change in the environment; and does not constitute an "approval'
of a "project" pursuant to CEQA Guidelines Sections 15004 and 15352.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim, serving as and on behalf of the Successor Agency to the Anaheim
Redevelopment Agency this 21 st day of May 2024 by the following roll
call vote:
AYES: Chairperson Aitken and Authority Members Kurtz,
Diaz, Leon, Rubalcava, Faessel and Meeks
