A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DENYING VARIANCE NOo 1040 .
.".-. WHEREAS, the City Planning Commission of the City of Ana-
heim did receive a petition for zoning variance from Richard .An~hoD.Yt
of certain real property
Anaheim, ounty of range, State of California,
Beginning at the Nor~hwes~ corner of Section 22. in !fowship 4

Rancho S8Zl Ju8Zl Oajon de Santa Ana, in the ca ty of .Anaheill
Ooun~y of Or8Zlge. S~ah of Oalifornia; thence due East along
~he cen~er line of :Ball Road. a distance of ))0.)1 feet, thence
due South at right 8Zl&les to the center line of :Ball Road. a
distance of 200 feet, thence due West a distance of 1)0.)1
feet peallel to the North line of Ball Road. thence due North
a distance of 200 feet parallel to the East boundry line.
AND WHEREAS, the City Planning Commission did hold a
public hear ing at the Ci ty Hall in the City of Anahe im on Ont:ftbfJ"
~iIh ,19 '>8 ,notices of which said public hear Ing were duly
given as required by law and the provisions of Section 9200.11 of the
Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due Inspec-
tion, Investigation and studies made by Itself and in its behalf, and
after due consideration of all evidence and reports offered at said
hearing, did adopt Resolution No. 76 , Series 19 '58-'59 ,Q'rIU'1t.1n{

WHEREAS, thereafter, within twenty (20) days from the date
of the adoption of said resolution, the City Council did elect, upon
its own motion, to review the action taken by the City Planning Com-
mission in ~ant1~ said variance and did set a public hearing
thereon to be held on the i"ioh day of Novellber. +9'18 , at 1 :00
o'clock P.M. in the City Hal in the City of Anaheim, and notice of
such public hearing was duly given as required by law and the provi-
sions of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right possessed by
other property in the same vicinity and eone and
denied the subject property.
2. It appears that the subject property can be ade-
quately developed and used under the present zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission
granting Variance No. 1040 for a Oocktail Lounge 8Zld Restauran~ be. and the s8llle
is hereby disapproved, and that Variance No. 1040 be. and the s8llle is hereby
denied.
