RESOLUTION NO. 4.394
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AGREEMENT FOR DEDI-
CATION OF PROPERTY FOR STREET PURPOSES. AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXE-
CUTE SAID AGREEMENT FOR AND ON BEHALF OF THE
CITY OF ANAHEIM.
WHEREAS, the owners of Lot 6 in the Orchard Park Tract,
of the City of Anaheim, Calirornia, as per map thereof recorded
in Book 6, Page 48 of Miscellaneous Maps, Records of Orange
County, California, excepting therefrom the Easterly 271.2 reet,
have filed with the City Council of the City of Anaheim a tenta-
tive map for the subdivision of said property under Tract No.
1886; and
WHEREAS, upon said map is shown a street 64 feet in
width extending to the easterly boundary of said proposed tract;
and
WHEREAS, it is the desire of the City Council that said
street be extended from the easterly boundary of said Tract No.
1886 through the easterly 271.2 feet of said Let 6 above described
to Palm Street; and
WHEREAS, the owners of the easterly 271.2 feet of said
Lot 6 above described have heretofore sold and conveyed to the
McCarthy Company all of the property above described, excepting
the easterly 271.2 feet thereof, and are desirous of seeing said
property developed and of consummating said sale, and are willing
to enter into an agreement with the City of Anaheim to dedicate,
or cause to be dedicated, for street purposes a portion of the
easterly 271.2 feet of Lot 6 of said Orchard Park Tract of the
same width as the street existing, or proposed, in said Tract
No. 1886;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City enter into an agreement with
Rose Ann Nugent, Sara M. Orr, Clementine T. Roberts, Frances K.
Robb, George E. Mattis, Alice M. Mattis, John M. Mattis, Michael
C. Mattis, and James J. Mattis, owners of the easterly 271.2 feet
of Lot 6 of said Orchard Park Tract for the dedication of property
for street purposes, upon the following terms and conditions:
1. That the owners of said easterly 271.2 feet or
said Lot 6 of said Orchard Park Tract shall
dedicate to the City of Anaheim, for street
purposes and improve, a strip of land extend-
ing from the easterly end of the street shown
in Tract No. 1886 to Palm Street. and that said
strip shall be of equal width to the street in
said Tract No. 1886.

2. That in the event said property is not developed
by the present owners, or any thereof, but is
sold to other persons, firms or corporations
that the escrow shall contain a condition that

said strip of land be dedicated to the City or
,- Anaheim ror street and utility purposes, and
improved, and that said property shall not be
sold and transr.rred to other owners unless
such owners or purchasers shall agree to the
dedieatien and iBprovement or said strip to the
City or Anaheim ror street and utility purposes.
3. That upon the execution or said agreement, the
City or Anaheim will approve the rinal tract map
or Tract No. 1886 when all other provisions are
met by the present owners or said property.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said agree-
ment for and on behalr of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 4th day of March, 1958.
