1967-072 RESOLUTION NO. 67R-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 905 WHEREAS, the City Planning Commission of 'the City of Anaheim did receive a request for a conditional use permit from EARL THOMAS SPRATLEN and CLARA C. SPRATLEN, 461 West Valley View Drive, Fullerton, California, and HECTOR M. PELAYO and ALICE PELAYO, 232 San Carlos Way, Placentia, California, to establish a service station at the intersection of a secondary highway and a local street, within 75 feet of a residential zone (Sections l8.40.060(c) and 18.64.020(5) of the Anaheim Municipal Code), and permitting a waiver of the maximum building height limitation (Section l8.40.070(3-a) of the Anaheim Municipal Code), on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Lots 43 and 44, Tract 2022, in the City of Anaheim, as shown on a map thereof recorded in Book 58, pages 24 and 25, Miscellaneous Maps, records of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hea~ing at the City Hall in the City of, Anaheim upon said request on December 19 , 19 66 , notices of which said public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of ,,11 evidence and reports offered at said hearing, did adopt its Resolution No. PC66-174 denying Conditional Use Permit No. 905 ; and WHEREAS, thereafter, within twenty-two days from.. the date of. the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said conditional USe permit and did thereupon fix the 17th, day of January , 19 67 ,as the time and the Council Chamber in the City Hall -1- of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ingand did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and - " WHEREAS, the City Council does find, after careful consideration of the recommendations of the City'P1anning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 905 should be denied. NOW THEREFORE, BE IT RESOLVED by the City Council of 'the City of Anaheim that the action of the City Planning Commis- sion ~ Conditional Use permit No. 905 be, and the s.me~sustained ,.. " and that the request of EARL THOMAS SPRA'rLEN and CLARA C. SPRATLEN, and HECTOR M. PELAYO and ALICE PELAYO for a conditional use permit to e~tablish an automobile service station at the inters~ction of a secondary highway and a local street, within 75 feet of a residential zone, and permitting a waiver of the maximum building height limitation, on the property hereinbefore described, be, and the same is hereby denied.
