1967-057 RESOLUTION NO. 67R- 57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING AN EASEMENT DEED IN CONNECTION WITH THE KATELLA AVENUE UNDERPASS. WHEREAS, it is necessary for the City of Anaheim in connection with the construction of the Katella Avenue railroad underpass to acquire both permanent and temporary easements over certain property owned by Ledger T. and Gladys K. Smith; and WHEREAS, Ledger T. and Gladys K. smith have offered to grant both temporary and permanent easements to the City in con- sideration of the City'S granting ingress and egress and construct- ing two 30-foot driveways on the Katella Avenue frontage of their property, and reimbursing said owners for trees removed or damaged in the construction of said underpass; and vlliEREAS, the City and said Ledger T. and Gladys K. Smith have entered into an agreement, dated December 20, 1966, providing for the granting of said easements by the owners in consideration of the City'S making the improvements, granting the access, and reimbursing the owners for certain trees, as hereinabove mentioned. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Easement Deed dated January 11, 1967, executed by Ledger T. Smith and Gladys K. Smith, granting to the City of Anaheim easements over the real property in the City of Anaheim, County of Orange, State of California, described as: PARCEL ONE: An easement for highway and public utility purposes over, under and across the following described parcel of land: Commencing at the center line intersection of Katella Avenue with the center line of Struck Avenue (now known as Howell Avenue), said point of intersection is described as a point bearing North 890 31' 35" West 1,218.67 feet from the intersection of the center line of said Struck Avenue, with the center line of Douglass Road, as said Douglass Road is described in deed recorded in Book 682, page 109 of Official Records of Orange County, California, as de- scribed in Parcel A of the Final Order of Condemnation to the County of Orange, recorded July 8, 1960 in Book 5321, pages 397 through 401, inclusive, of Official Records of Orange County, California, said center line of Katella Avenue, being in a curve concave Southeasterly and having a radius of 1,000 feet; thence Southwesterly along the center line of said Katella Avenue along said curve through a central angle of 410 20' 1011 an arc distance of 721.45 feet, to a point hereinafter referred to as Point A; thence North 410 06' 2111 vvest a distance of 60 feet; thence South 480 53' 3911 wiest 176.91 feet to the true point of beginning of the hereinafter described parcel of land; thence South 540 54' 58" West a distance of 311.37 feet to an intersection with the Northeasterly line of the Atchison, Topeka and Santa Fe Railway Company -1- right of way line (100 feet wide); thence South 70052' 0911 East 37.63 feet along a portion of the Northeasterly line of said railroad right of way to an intersection with a line parallel with and 60 feet Northerly of the center line of the aforementioned Katella Avenue; thence North 480 53' 3911 East 290.97 feet to the true point of beginning. PARCEL TWO: A temporary easement for the construction, maintenance and operation of a railroad shoofly over, under and across the following described parcel of land: Commencing at Point A as established in Parcel One above described; thence North 410 06' 21" West 60 feet; thence South 480 53' 3911 West 176.91 feet; thence South 540 54' 5811 West 311.37 feet to an intersection with the Northeasterly line of the Atchison, Topeka and Santa Fe Railway Company right of way line (100 feet wide) , said point of intersection being the true point of beginning; thence North 700 52' 09" West 725.47 feet along the . Northeasterly line of the last mentioned Atchison, Topeka and Santa Fe Railway right of way line (100 feet wide) to a point; thence South 770 40' 29" East 290.52 feet, leaving the Northeasterly line of said railway company right of way to the beginning of a tangent curve concave Southwesterly and having a radius of 2,900 feet; thence Southeasterly along said curve through a central angle of 90 23' 2411 an arc distance of 475.27 feet; thence South 540 54' 5811 West 63.99 feet to the true point of beginning. be, and the same is hereby accepted by the City Council of the City of Anaheim. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized and directed to record said deed.
