RESOLUTION NO. 4340
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING WITHOUT PREJUDICE AMENDED
VARIANCE NO. 823.
WHEREAS, the City Planning Commission o~ the City o~
Anaheim did receive a petition trom the owner o~ certain real
property situated in the City of Ananeim. County o~ Orange, State
o~ California. described as follows:
That portion of Lot 29 of Anaheim Extension, in the City
of Anaheim. County of Orange, State of California, as
surveyed by William Hamel, December 11, 1868 and ~iled
for record in the office of the County Recorder o~ Los
Angeles County, California. a copy thereof being on file
in the of~iee of the County Recorder of Orange ,County,
California, in Book 3, Pages 163. et seq.. of Los Angeles
County Maps, and that portion of Citron Street abandoned
by the Board o~ Supervisors by petition filed May 1, 1913
in Road Book 2, Page 234 in the office of the County
Clerk o~ said Orange County, described as a whole as
~ollows:
Beginning at the center line intersection of Vermont
Avenue (~ormerly Broad Street) and Citron Street as
&hown on said map; thence South 14- 34' west along the
center line ot said Broad Street to the easterly line
of the right o~ way of the Southern Pacific Railroad;
thence southeasterly along the easterly line of said
right o~ way to the center line o~ said Citron Street;
thence northwesterly along said center line o~ Citron
Street to the point of beginning.
EXCEPT the easterly 160.00 feet of the northerly 183.00
feet measured along and from the center lines of streets
adjoining.
ALSO EXCEPT that portion thereof lying westerly o~ the
tollowing described line as cited in Deeds to the State
o~ California recorded March 19. 1951. in Book 2160,
Page 280, Official Records of said Orange County and
March 14. 1956 in Book 3435, Page 472. Official Recorda
ot said Orange County:
Beginning at the intersection of the center line ot
Vermont Avenue with a line parallel with and 65 ~eet
northeasterly measured at right angles from the north-
easterly line or the Southern Pacific Railroad right of
way; thence southeasterly 793.31 feet along said parallel
line to the beginning of a tangent curve concave to the
northeast and having a radius of 250.00 feet; thence
southeasterly along said curve to the said center line o~
Citron Street.

AND WHERElS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on January 6,
1958, notices ot which said public hearing were duly given, as
required by law and the provisions of Section 9200.17 of the Anaheim
Munioipal Code; and

WHEREAS, said City Planning COmmission, after due in-
spection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
ottered at said hearing, did adopt Resolution No. 146 -- Series
1957-58, recommending that Amended Variance No. 823 be granted
upon the conditions therein set forth; and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution a written appeal was filed
with the City Council of the City of Anaheim protesting the action
of the City Planning Commission granting said variance, and said
appeal was .et for public hearing on the 4th day of February, 1'58,
at 1:00 o'clock P.M., in the City Hall in the City of ADaheim, and
notice of suoh pUblic hearing was duly given as required by law
and the provisions of Section 9200.11 of the Anaheim Municipal
Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such pUblic
hearing and did give all persons interested therein an opportunity
to be heard; and
WHEREAS, after dlle investigation and studies made by
itself and in ita behalf, and after dll. consideration of all the
evidence and reports ottered at said hearing, the City Council does
find that:
1. There is no substantial property right
posseased by other property in the same
vicinity and zone and denied the subject
property.
2. It appears that the subject property can
be adequately developed and used under
the present zone.
NOW', THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Co-.1ssion
granting Amended Variance No. 823, requesting permission to erect
a modern automobile service plant on the property hereinabove
described, be~ and the same is hereby disapproved, and that Amended
Variance No. b23 be, and the same is hereby denied, without
prejudice.
THE FOREGOING RESOLUTION is approved and signed by me
this 4th day of February, 1958.
