58R-4333 RESOLUTION NO. 4333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 884> WHEREAS, the City Planning Commission of the City of Ana- heim did receive a petition from the property owner and/or agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 25 of Tract No. 483~ as per map thereof recorded in Book 17~ Page 20 of Miscellaneous Maps~ Records of Orange County~ California. (Said property is located at 1819 West La Palma Avenue~ Anaheim~ California) AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on December 16. 1957 , notices of which said public hearings were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 142 ,recommending to the City Coun- cil of the City of Anaheim that Variance No. 884 be granted upon the conditions stated in said resolution; and WHEREAS, the City Councn does find that: 1, There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to WILLIAM H. WARD, 246 East Center Street~ Anaheim~ California~ to use the existing residence located on the property hereinabove described for a residence and plumbing shop~ upon the following conditions: -1- .'~-~~"~~'''_ _......._...-..._h.___'_ ....".,...____,_._._....,..,_,,__..~.,_,._..,.~ "_..,,.,__......_., 1. That the owner of subject property deed to the City of Anaheim a strip of land 50 feet in width, from the center line of the street, along La Palma Avenue for street widening purposes. 2. That all engineering requirements of the City of Anaheim be complied with as required by the City Engineer; and that the owner of subject property provide improvements in accordaace with the sketch prepared by the City Engineer, submitted to the City Cpuncil, and on file with the City of Anaheim. 3. That the owner of subject property obtain an encroachment permit allowing the front steps of the dwelling to remain on the parkway, which permit shall be issued for a maximum period of two (2) years from date hereof. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or assigns, to comply with the AnaheiRlMunicipal Code and regulations and the conditions herein.
