58R-4322 RESOLUTION NO. u.322 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 880). WHEREAS, the City Planning Commission of the City of Ana- heim did receive a petition from the property owner #I{I.1,'.....x of certain real property situate~n the City of Anaheim, County of Orange, State of California, described as follows: The East 300 feet of Lot 1, Tract 10. 2854, as per map recorded in Book 90, pag.. 39 and 40 of Miscellaneous Maps, in the office of the Couuty Recorder of Orange Couty, EXCEPTIIG THEREFROM the Nerth 960 feet and ALSO EXCEPTIlfG THEREFROM that portion thereof lying South of a line paral- lel with and 210 feet North of the South line of the Southeast quarter of Section 21, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, California. AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on Deea.ber Ib, lqt;7 , notices of which said public hearings were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 138 ,recommending to the City Coun- cil of the City of Anaheim that Variance No. 880 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to JOHN J. COX, 1740 I. Highland Avenue, RoIIyvood, California, to construct and operate a Motel with a Swimaing Pool on the hereinabove described property, subject to the following conditions: -1- . ~,...'->e',"" """'''~'.,==",='. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage racilities or other pertinent work be complied with as required by the City Engineer. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or 1I1...-k-. his heirs, successors or assigns, to comply with the AnaheiITlMunicipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
