OF ZONE IS NECESSARY IN CERTAIN AREAS 0Jl' THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF TH! ANAHEIM MUNICIPAL COOE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE.. WHEREAS, th.City Planning Commission of the City of Ana- hel. has heretofore duly puud and adopted a ruolutlon d.clarlng it. Intention to change the boundaries of the zone or zones her.in- art.r mentioned and d..crlbed and did fix a time and place for the holding of a public h.aring thereon in the manner and a. pre.crib.d in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from person. Int.rested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by for..l resolution its findings of facts and declare it. opinions and rea.ons for recommending an amendment to said Article IX, Chapter 2 ot the Anaheim Municipal Code to effect the proposed chang.. in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 1st day of ~U1rr ' 19 sa , as the tlme and the Council ~in the ~ity al of the City of Anaheim as the place for a publiC hearing upon said proposed change of zone, and did give notice th.reof in the manner and al provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for laid pUblic h.ar- ing, the City Council did duly hold and conduct luch public h.aring and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did th.r.upon con- sider the recommendations of the City Planning Commi..ion; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it il now tltuated to a different zone, al hereinarter set rorth, il more luitable for the zone or zon.. to which It i. propolld to change .aid property and area and that the Inclusion of said property and ar.a in such n.w zone or zones will increale the value or said prop.rty and area and will not depreciate the valuel of property In adJoln!ng zones. NOW, THEREFORE, BE IT RESOLVED by the CIty Councilor the City of Anaheim that all of the property and area lituated in the City of Anaheim, County of Orange, State of California, described .. fo11oww, to wit: The North One and 89/100 acres of the following described property: That portion of Lot 29 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as surveyed by William Hamel, December 11, 1868 and filed for record in the Office of the County Recorder of Los Angeles County, California, a copy thereof being on file in the Office of the County Recorder of Orange County, California, in Book 3, Pages 163 et seq., of Los Angeles County Maps, ,":'Si-l.':, -1- . 1-57-58-57 . " ; ,- and that portion of Citron Street abandoned by the Board of Supervisors by petition filed May 7, 1913 in Road B00k 2, Page 234, in the Office of the County Clerk of said Orange County, described as a whole as follows: Beginning at the center line intersection of Vermont ATenue (formerly Broad Street) and Citron Street as shown on said map; thence South 740 301 West along the center line of said Vermont Ave... to the easterly line of the right of way of the Southern Pacific Railroad; thence southeasterly along the easterly line of said right of way to the center line of said Citron Street; thence northwesterly along said center line of Citron Street to the point of beginning. EXCEPT the easterly 160.00 feet of the northerly 183.00 feet measured along and from the center lines of streets adjoining. ALSO EXCEPT that portion thereof lying westerly of the following described line as cited in Deeds to the State of California, recorded March 19, 1951, in Book 2160, Page 280 of Official Records of said Orange County and March 14, 1956 in Book 3435, Page 472, Official Records of said Orange County: Beginning at the intersection of the center line of Vermont Avenue with a line parallel with and 65.00 feet northeasterly measured at right angles from the north- easterly line of the Southern Pacific Railroad right of way; thence southeasterly 793.31 feet along said paral- lel line to the beginning of a tangent curve concave to the northeast and having a radius of 250.00 feet; thence southeasterly along said curve to the said center line of Citron Street. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to R-3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: - 1. That the owner of subject property place of record standard City of Anaheim R-3 Deed Restrictions approved by the City Attorney, which restrictions shall limit the height of all buildings constructed on subject property to not exceeding two stories, with the exception of the buildings erected on the northerly 100 feet thereof, which shall be limited to one story; and shall provide that the construction of said buildings be comparable in quality, design and appearance to the development on the property immediately to the east of subject property. 2. That all engineering requirements of the City of Anaheim, along Vermont Ave~e, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other pertinent work be complied with as required by the City Engineer. 3. That all of the above conditions shall be complied with within a period of six (6) months from date hereof; provided, however, that a bond, approved by the City Attorney, may be posted with the City in an -2- ",....- amount sufficient to cover the engineering require- ments in Condition No.2, if said improvements are not required by the City Engineer within said six- month period. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
