RESOLUTION NO. 4583
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM EMPLOYING BOYLE ENGINEERING, A
CORPORA TION, CONSULTING ENGINEERS, TO MAKE AND
PREPARE. PRELIMINARY STUDIES, SURVEYS, DESIGNS,
TEST BORINGS, SUBSURFACE INVESTIGATIONS, AND
SUCH DESIGN AND CONSTRUCTION TESTS AS MAY BE
REQUIRED FOR THE LOCATION AND. CONSTRUCTION OF
A WATER RESERVOIR AT OR NEAR BURRUEL POINT AND
THE PROPOSED WATER TRANSMISSION MAIN BETWEEN
SAID RESERVOIR AND THE PROPOSED CONNECTION TO
THE METROPOLITAN WATER DISTRICT SUPPLY MAIN
ALONG RAYMOND. STREET IN THE CITY OF ANAHEIM;
AND FIXING COMPENSATION.
WHEREAS, the City Counci~ finds that the City of
Anaheim is rapidly expanding in area and increasing in popu-
lation and that there is an ever increasing demand for water
for domestic, commercial and industrial uses; and
WHEREAS, the growing demand for water and the antici-
pated future demand for water will tax the facilities of the
City Water Department to adequately supply such demands, and it
is necessary to make and prepare preliminary studies, surveys,
designs, test borings, subsurface investigations, and such design
and construction tests as may be required for the location and
construction of a water reservoir at or near Burruel Point and a
transmission main between said reservoir and the proposed con-
nection to the Metropolitan Water District supply main along
Raymond Street in the City of Anaheim and that it will be neces-
sary to construct an additional reservoir or reservoirs in the
near future to supply the future demands for water in territories
which it is anticipated will be annexed to and become a part of
the City, and detailed plans and specifications for such water
storage reservoirs and transmission mains should be prepared; and
WHEREAS, the City Council finds that Boyle Engineering,
a Corporation, composed of consulting engineers, of Santa Ana,
California, is qualified and capable of making such preliminary
studies, surveys, designs, test borings, subsurface investigations,
and such design and construction tests as may be required in pre-
paring such detailed plans and specifications, and that it has
offered to furnish the services hereinafter specified for the
compensation and upon the terms and conditions set forth herein;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Boyle Engineering, a Corporation, 331
Spurgeon Building, Santa Ana, California, be, and it is hereby,
employed by the City of Anaheim to perform and render the follo~
ing services:
1. To make a brief review of the present and future
requirements of the City of Anaheim in relation
to said reservoir and transmission main.

2. To prepare specifications for general supervision
of and office advice concerning test borings, sub-
surface investigations, and such design and con-
struction tests that may be required.

3. To prepare engineering design and make an analysis
of the facilities proposed for construction.
4. To prepare detailed plans and specifications for
construction of said facilities.
5. To prepare quantity and cost estimates for said
work.
6. To assist in securing construction bids and in the
analysis of said bids.
7. To assist in letting construction contracts for
said work.
8. To check shop and working drawings prepared by
contractors outlining the proposed construction
methods to be utilized by said contractors.
9. To render general supervision, consultation and
advice during the construction of said facilities.
10. To review estimates for progress and final payments
to contractors.
11. To assist in tune-up and testing of equipment.
12. To prepare record drawings incorporating therein
any construction changes.
13. To make final inspection of the work and report to
the City.
14. Field Engineering Services: (a) To make field
engineering surveys to determine topography, profile
data, and locations of physical features at the
reservoir and pumping station sites. (b) To furnish
detailed supervision of construction by a resident
engineer-inspector, and/or survey parties, to the
extent requested by the City of Anaheim; the number
of persons to be employed and the compensation to
be paid them for such services to be approved by
the City Council of the City of Anaheim prior to
such employment and the furnishing of such services.
BE IT FURTHER RESOLVED that said Boyle Engineering shall
commence the performance of the services herein specified to be
rendered by it upon the completion of a contract to be made and
entered into by and between the City of Anaheim and said consult-
ing engineers; and shall proceed diligently therewith and complete
the preliminary studies, surveys, designs, test borings, sub-
surface investigations, design and construction tests, field
surveys, profile data, and locations within a period of six (6)
msmths

BE IT FURTHER RESOLVED that said Boyle Engineering shall
receive as full compensation for the engineering services and
work herein specified a total fee equal to 5.5~ of the construction
cost of the proposed work, which said fee shall. be limited to the
services hereinabove specified and such changes and additions
thereto as the City shall from time to time authorize or approve.
The fee for the above engineering services and work shall be paid

in installlllents, wi th 5.00~ or the estimated construction cost
or the racili ties to be paid upon the completion or the above
Items 1 to 5, inclusive, ror each phase or the proposed COD-
struction, and the balanee or the rea to be paid upon the CO.lll-
pletion or all or the above items for eaeh phase or the proposed
construction. .
BE IT FURTHER RESOLVED that Boyle Engineering shall
rurnish all equipment, materials, and transportation and shall
execute the required orrice and rield work, including boundary
and topographical surveys and legal d,escriptions ror rights or
way and property acquisition at the following rates:
$16.50 per hour for each 3-man 8u~~ey partyao engaged.
$7.50 per manhour rororriee personnel so engaged, which
rees shall be in addition to those speciried fnthe preceding
paragraph.
Detailed construction inspection, subsurrace explor-
ations, design and construction tests, construction surveys and
staking as may be required by the City shall be rttrnished by
Boyle Engineering at the direct expense of the City and in a
.anner to be mutually agreed upon between the City and the
Engineer.
BE IT FURTHER RESOLVED that U, at any time prior to
the cOlllpletion or Items 1 to 5 above mentioned, during the term
or the employment or said Engineer, it is desired by the City
to cancel the contract with said Engineer, and an equitable adjust-
ment cannot be arrived at between the City and said Engineer, or
ir the work should be suspended or abandoned berore completion,
the City shall pay to the Engineer in rull and final settlement
ror work perrormed prior thereto, the actual payroll costs of the
Engineer to the time or such abandonment, plus a sum equal thereto.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk or the Ci ty or Anaheim be, and they are hereby, authorized
and directed to make and execute a contract ror and on behalr or
the City or Anaheim wi th said Boyle Engineering, a Corporation,
consulting engineers, upon the terms and conditions herein
speciried.
THE FORmOING RESOLUTION is approved and signed by me
