WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on the a notice inviting furnishing the 1'0 . All plant, labor, services, materials and equipment, and all utili- ties and transportation including power, fuel and water, and per- forming all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clerk or the City Engineer, the following public improvement: The con- struction and completion of Public Utilities and Purchasing Offices for the City of Anaheim at 518 South Los Angeles Street, consist- ing of a 6,000 sq. ft. in area, two-story briek masonry building with concrete slab first floor, wood frame second floor, wood fr..e roof and interior wall construction, exterior and interior plaster finishes, sheet metal work, composition roofing, extruded aluminum store front, glass and glazing work, ceramic tile, composition f'looring, plastie surfacing, millwork and wood cabinets, acoustical tile, insulation, toilet partitions, plumbing, air conditioning, electrical, and all appurtenant work as indicated on the plans, Job 1'0. 399, in accordance with the design, plan~, prof'iles and specifications of' said public improvement on file in the off'ice of the City Clerk of the City or Anaheim; and WHEREAS, said notice inviting sealed proposals f'or said public improvement did provide that sealed proposals would be received by the City of' Anaheim at the off'ice of the City Clerk of' the City of' 4naheim up to the hour of' 2:00 o'clock P.M. on the 2Qth day of M~ . 19~, for the fUrnishing of all plant, labor, services, mater als, and equipment, all utilities and transportation, including power, fUel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of' the Labor Code, the City Council of the City of' Anaheim had ascertained the prevailing rate of wages in the locality in which this type of' labor is to be performed for each craf't or type of workman or mechanic needed to execute the contract and did set f'orth the prevailing hourly wage scale so ascertained; and ,- WHEREAS, the City Clerk of' the City of Anaheim did following sealed proposals prior to 2:00 o'clock P.M. on day of' MiY , 19~, in. response to the notice inviting sea ed proposals, to wit: receive the the 29ft- af'oresai -1- ~ TOTAL PRICE ~ TOTAL PRICE ,..........,.." DEVORE 81,886.00 LONG CONSTRUCTION .92,000.00 AND WHEREAS, the City Engineer did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposal submitted by Larry &: Jaok Builders, Ino. is the lowest proposal submitted and that the b1d of Don M. Fletcher, 18722 E. Fairhaven, Santa Ana, California, is the next lowest responsible proposal submitted for the furnishing of all plant, labor, servioes, materi- als and equipment, and all utilities and transportation, including power, fuel and water and performing all work necessary to oon- struct and complete in a good and workmanlike manner, in strict accordanoe With the specifications, plans and drawings therefor on file in the office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and desoribed, together With the appurtenances thereto, and as specified in the notioe inviting sealed proposals, but that a clerical and mechanical error was made by Larry &: Jaok Builders, Inc. in the computation of their bid, and that they have requested leave to Withdraw said bid beoause of said error and the faot that they would suffer a loss if oom- pelled to aocept and complete the contract for said improvement; and liHEREAS, the City Engineer has examined the work sheets and oomputations of said Larry &: Jaok Builders, Inc. and has re- ported to the City Counoil that they did, in truth and in faot, make a clerioal and meohanical error in their computations and that the amount of their bid is less than the estimated cost or the improvement; and that, in his opinion, they would suffer a loss if required to oonstruot and oomplete said project in aooordanoe with the bid submitted by them, and has recommended that they be relieved by being allowed to withdraw their bid; and WHEREAS, the City Counoil finds that the sealed proposal of Don M. Fletcher is the seoond lowest responsible proposal received, that the person submitting said proposal is a responsible person, and that the proposal submitted by him is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE I T RESOLVED by the City Council of the City of Anaheim, that the sealed proposal submitted by Don M. Fletcher, 18722 E. Fa1rhaven, Santa Ana, California, for the furnish- ing of all plant, labor, servioes, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict acoordance with the specifications, plans and draWings therefor on file in the office of the City Clerk of the City of Anaheim and the notioe inviting sealed proposals, the public works and improvement hereinabove more particularly mentioned and described, together With the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the construction and oompletion of said public improvement be, and the same is hereby, awarded to the said above named bidder. AND BE IT FURTHER RESOLVED that the suooessful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby required to execute a contraot in the required form With the City of Anaheim upon the terms and oon- ditions speoified 1n the notice inviting sealed proposals and the proposal submitted by said sucoessful bidder or bidders and in aocordanoe With the plans and specifioations for said publio improvement hereinabove described, and in aoeord- -2- ance with the terms, conditions and provisions of this resolutions and that said suooessful bidder or bidders to whom eaoh contraot is awarded shall be required to furnish a surety bond in an amount equal ,- to one hundred per cent (100%) of the contraot price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public improvement, together with the appurtenances thereto or such portion thereof as is covered by said contraot, as security for the faithful performance of said contract and a separate surety bond in an amount equal to one hundred per cent (100%) of the oon- struction cost of said public improvement covered by said contraot, as security for the payment of all persons performing labor and fur- nishing material for said projecto AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfaotory to the City of Anaheim, public lia- bility, property damage, compensation, and other insuranoe in the amounts and for the purposes as set forth and specified in the notioe inviting sealed proposals, and subject to the approval of the City Attorney as to form and suffioienoy. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said sucoessful bidder or bidders for the furnishing of all plant, labor, materials, and equip- ment and performing all work, as hereinabove more particularly des- cribed, for the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general speoifications and de- tailed specifications and drawings, and all addenda thereto, and all modifioations incorporated therein prior to the date of the opening of bids, on file in the office of the City Clerk of the City of Ana- heim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract doou- ments herein specified.
