RES-2024-094RESOLUTION NO. 2024- 0 9 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, RESCINDING THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF ANAHEIM AN INITIATIVE MEASURE IMPOSING A GENERAL TAX ON EACH FOR -PROFIT GENERAL ACUTE CARE HOSPITAL LOCATED IN THE CITY OF ANAHEIM EQUIVALENT TO THREE (3) PERCENT OF THE FOR - PROFIT HOSPITAL'S ANNUAL GROSS RECEIPTS AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 2024, AS CALLED BY RESOLUTION NO. 2024-087, AND REPEALING RESOLUTION NO. 2024-087 WHEREAS, a General Municipal Electron on Tuesday, November 5, 2024 has been called by Resolution No. 2024-087, adopted on July 23, 2024, to place before Anaheim voters an initiative measure imposing a three (3) percent tax on the gross receipts of for -profit acute care hospitals in the City ("initiative measure" or "measure"); and WHEREAS, pursuant to Section 9215.5 of the California Elections Code, the proponent of the initiative measure filed a "Request for Withdrawal of Initiative, and WHEREAS, pursuant to Section 9605 of the California Elections Code, the City Council desires to rescind the ballot question relating to the initiative measure due to the proponent's withdrawal of the measure. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Council, pursuant to its right and authority, repeals Resolution No. 2024- 087 in order to remove the following ballot question from the November 5, 2024 General Municipal Election: MEASURE _ YES CITY OF ANAHEIM FOR -PROFIT HOSPITAL GROSS RECEIPTS TAX INITIATIVE - Shall the measure imposing a general tax on each for -profit general acute care hospital located in the City of Anaheim, equivalent to three (3) percent of the for -profit hospital's yearly gross receipts (as defined in NO the measure) be adopted, with annual revenues to the City projected to be in the range of $6 million to $12 million, until ended by the voters? SECTION 2. That in all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 3.
