CONSTRUCTION CO. $ 3,667.01 3,940.80 4,036.91 4;1+76.04 AND WHEREA&, the City Engineer did thereupon examine and tabu- late said sealed proposals and did report to the City Council the re- sult of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposal sub- mitted by R. J. NOBLE COHPANY, P. O. BOX 620, ORANGE, CALIFORNIA is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings there- for on file in the office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice inviting sealed proposals, and that said proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the City Council finds that the above mentioned sealed proposal is the lowest responsible proposal received and that the per- son, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that the sealed proposal submitted by R. J. NOBLE COMPANY P C BO': 6 0 ORrI.NGE C.ALIFOR"; for the urnishing of all plant, labor, servic~s, materials and equip- ment, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clerk of the City of Anaheim and the notice inviting sealed proposals, the pub- lic .works and improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, he, and the same is hereby, accepted, and that a contract for the construction and com- pletion of said public improvement be, and the same is hereby, awarded to the said above named bidder. ~ AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby required to execute a contract in the required form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said success- ful bidder or bidders and in accordance with the plans and specifica- tions for said public improvement hereinabove described, and in accord- -2- ,-., - ance with the terms, conditions and provisions or this resolution, and that said successrul bidder or bidders to whom each contract is awarded shall be required to rurnish a surety bond in an amount equal ,~ to one hundred per cent (100%) or the contract price for all labor, materials and equipment to be rurnished and perrormed, as set rorth in the sealed proposal submitted by said bidder ror the construction or said public improvement, together with the appurtenances thereto or such portion thereor as is covered by said contract, as security ror the raithrul perrormance or said contract and a separate surety bond in an amount equal to one hundred per cent (100%) or the con- struction cost of said public improvement covered by said contract, as security ror the payment or all persons perrorming labor and rur- nishing material ror said project. AND BE IT FURTHER RESOLVED that said successrul bidder or bidders be, and they are hereby required to rurnish to the City of Anahei. in companies satisfactory to the City or Anaheim, public lia- bility, property damage, compensation, and other insurance in the amounts and for the purposes as set rorth and speCified in the notice inviting sealed proposals, and subject to the approval of the City Attorney as to form and surriciency. AND BE IT F'URTHER RESOLVED that the Mayor and the City Clerk or the City or Anaheim be, and they are hereby, authorized and direoted to make, execute and enter into, ror and on behalr or the City of Anaheim, a writtan contract with said successrul bidder or bidders for the rurnishing or all plant, labor, materials, and equip- ment and performing all work, as hereinabove more particularly des- cribed, for the construction, installation and completion or said public improvement hereinabove described upon the terms and conditions as speciried in the notice inviting sealed proposals, the detailed design, plans, proriles, drawings and general speoirications and de- tailed 8pecif~cation, and drawings, and all addenda thereto, and all modifioations incorporated therein prior to the date or the opening of bids, on file in the ofrice of the City Clerk or the City or Ana- heim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all or the contract doou- ments herein specified.
