RESOLUTION NO. 4502
A RESOLUTION OF THE CIlY COUNCIL OF THE CIlY
OF ANAHEIM APPROVING AN AGREEMENT TO BE MADE
AND ENTERED INtO FOR THE INSTALLATION AND
MAINTENANCE OF LIGHTING FACILITIES ON CERTAIN
PROPERlY OWNED BY THE. ANAHEIM. UNION HIGH
SCHOOL DISTRICT AND FOR THE MAiNTENANCE OF
SAID PROPERlY, FOR USE IN THE JOINT PROGRAM
OF COMMUNITY RECREATION OF THE CIlY OF ANAHEIM,
THE ANAHEIM UNION HIGH SCHOOL DISTRICT, AND
THE ANAHEIM ELEMENTARY SCHOOL DISTRICT; AND
AUTHORIZING THE MAYOR AND THE CIlY CLERK TO
EXECUTE SAID AGREEMENT. ..
WHEREAS, the City of Anaheim and the Anaheim Union High
School District, together with The Anaheim Elementary School
District, have heretofore entered into an agreement for a joint
program of community recreation; and
WHEREAS, the City Council does find and determine that
in aid of said program, it is convenient to enter into an agree-
ment whereby lighting facilities are to be installed on certain
property owned by the Anaheim Union High School District for use
as a lighted softball field, which lighting facilities are to be
maintained by the City of Anaheim, and said softball field is to
be maintained by the Anaheim Union High School District;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City of Anaheim enter into an agree-
ment for the installation and maintenance by the City of lighting
facilities on a portion of the Girls' Athletic Field at Western
High School, owned by the Anaheim Union High School District, to
be used as a softball field, and for the maintenance of said
property by the Anaheim Union High School District, on the follow-
ing terms:
1. The Anaheim Union High School District shall specify
that a portion of the property known and designated
as the Girls' Athletic Field at Western High School
is to be used as a lighted softball field, shall
maintain said property as a softball field, and shall
provide the necessary upkeep and maintenance of such
field in connection with its use.

2. The City of Anaheim shall draw specifications for
installation, shall install all necessary poles,
wires, conduits, and all necessary equipment for
providing adequate lighting of such field as a
lighted softball field, shall supervise the in-
stallation, and shall be responsible for all upkeep
and maintenance of said lighting system.
3. That said lighted softball field shall be used in
conjunction with the community recreation program
and shall also be used in connection with the school
physical education program.

4. That all lighting facilities, poles, wires,
conduits, etc., installed by the City on said
property shall be and remain the property of
the City, and may be removed by it at any time
upon termination of said agreement.
5. That the term of said agreement shall be from
the 1st day of May, 195$ through the 30th day
of April, 1968; provided, however, that should
the parties to said agreement fail at any time
to enter into an agreement with each other for
a joint program of community recreation, then
in such case said agreement may be terminated
by either party upon one hundred eighty (180)
days' written notice.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and
directed to execute said agreement for and on behalf of the City
of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 6th day of May, 1958.
