A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 941.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition from the purchasers and
recorded owner of certain real property situated in the City
of Anaheim, County of Orange, State of California, described
as follows:
The West five (5) acres of the North eighteen
(18) acres of the East thirty (0) acres of the
Northeast quarter of the Northwest quarter of
Section 13, Township 4 South, Range 11 West,
S.B.B. &. M.;
EXCEPTING THEREFROM the North 66 feet.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said petition on April 7, 1958, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim MUnicipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf, and
after du.e consideration of all evidence and reports offered at
said hearing, did adopt Resolution No. 223--Series 1957-58,
recommending to the City Council of the City dfAnaheim that
Variance No. 941 be granted upon the conditions therein set
forth; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in granting said variance and
did set a public hearing thereon to be held on the 6th day of
May, 1958, at 7:00 o'clock P.M. in the City Hall in the City
of Anaheim, and notice of such public hearing was duly given
as required by law and the provisions of Section 9200.17 of
the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports, and did
thereupon consider the recommendations of the City Planning
Commission; and

WHEREAS, after due investigation and studies made
by itself and in its behalf, and after due consideration of
all the evidence and reports offered at said hearing, the
City Council does find that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting Variance No. 941, requesting permission
to operate a Tractor Sales and Service on the property here-
inabove described, be, and the same is hereby diSapproved,
and that Variance No. 941 be, and the same is hereby, denied.
THE FCREOOING RESOLUTION is approved and si gned by
me this 6th day of May, 1958.

vided by law, of the. City Council of the City of Anaheim,
held on the 6th day of May, 1958, by the following vote:
AYES: COUNCILMEN: Pearson, Borden, Fry and
Coons.
NOES: COUNC ILMEN : None.
ABSENT: COUNCILMEN: Schutte.
AND I FURTHER CERTIFY that the Mayor of the Ci ty
of Ana~eim approved and signed said resolution on the 6th
day of May, 1958.
