A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DELEGATING TO THE DIRECTOR OF PUBLIC
WORKS THE AUTHORITY TO EXECUTE CHANGE ORDERS
ON PUBLIC WORKS AND ESTABLISHING LIMITATIONS
THEREON AND RESCINDING RESOLUTION NO. 2017-047
WHEREAS, the City Council of the City of Anaheim has heretofore previously
adopted Resolution No. 2017-047, which delegated certain authority to the Director of Public
Works with respect to execution of change orders on public works; and
WHEREAS, change orders to increase the City's cost of a public work are
frequently necessary and desirable; and
WHEREAS, it has become necessary to clarify the change order authority when
change order amounts do not increase the original contract amount approved by City Council and
when the 10% of the total contract price is exceeded for smaller projects between $100,000 and
$500,000; and
WHEREAS, it is still necessary and desirable that the authority to approve certain
change orders be delegated to the Director of Public Works.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Director of Public Works, or designee, is hereby authorized to approve,
in writing, any change orders under the following conditions:
a) For contracts equal to or less than $100,000, the change orders shall not
collectively exceed $10,000 increase to the contract price.
b) The change orders for each contract in excess of $100,000 shall not
collectively exceed an amount equal to $50,000 or 10% of the total
contract price as set forth in the contract, whichever is greater. The City
Manager shall be notified anytime of contracts that exceed 50% of the
change order authority and cumulatively add $250,000 to the original
contract amount.
c) Individual change orders shall not exceed $250,000 contract increase.
d) For change orders of any amount, the final change order that serves to
decrease the contract amount as part of the contractor's final pay
quantities.
2. The City Manager, or designee, is hereby authorized to approve, in writing,
change orders under the following conditions:
a) Individual change orders in an amount greater than $250,000, but less
than $400,000. City Manager, or designee, shall report such approved
change orders at the next available City Council meeting.
b) Agendize for City Council consideration, .any change order that exceeds
the authority established herein.
c) Change orders that exceed the authority established herein, if the City
Manager determines that public health, safety may be jeopardized,
subject to ratification by City Council.
BE IT FURTHER RESOLVED that Resolution No. 2017-047 shall be rescinded
upon the operative date of this Resolution.
