58R-4821 - ,- RESOLUTION NO. 4821 A RESOLUTION OF THE CITY OOUNCIL OF THE OITY OF ANAHEIM INITIATING PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, ON ITS OWN MOTION; DESIGNATING THE TERRITORY AS THE DESORIBIN~YB~~~ TERRITORY j PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Counoil of the City of Anaheim has in- vestigated certain uninhabited territory as hereinafter set forth and does find that such territory is so situated as to require faoilities of the City of Anaheim to pass through suoh territory, and does find that such territory can be easily served with the faoilities of the City of Anaheim and does further find that servioe of other areas in the City of Anaheim will be faoilitated by annexation of suoh uninhabited territory, and that annexation of such territory will be in the best interest of the City of Anaheim and the best interest of the area to be annexed; and WHEREAS, the City Oounoil does hereby determine that proceedings for the annexation of the hereinafter described uninhabited territory should be initiated by the City Counoil on its own initiative; and WHEREAS, the proposal for the annexation of the terri- tory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Oommission with respeot to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to laid Oity of Anaheim is situated in the Oounty of Orange, State of Oalifornia and is oontiguous to the City of Anaheim and is uninhabited territory; and WHEREAS, the City Counoil finds from evidenoe and reports reoeived that said new territory proposed to be annexed to said City of Anaheim does not form a part of any munioipal corporation and that said territory is uninhabited and is oon- tiguous to the City of Anaheim; and WHEREAS, the City Oounoil finds that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: ,-' -1- HURRAY MANOR ANNEXATION ,-, A parcel of land located in the County of Orange, State of California, being a portion of Sections 7 and 8 of Township 4 South, Range 10 West, S. B. B. and M., more particularly described as follows: Beginning at a point in the existing City limits line as established by the Gilbert Street Annexation to the City of Anaheim, passed by Ordinance #868 on November 24, 1953, and filed with the Secretary of State, January II, 1954, said point also being In the Southwesterly right of way line of the Southern Pacific railroad, being a point In a line S 57013130" E, 329.87 feet distant fram the west line of said Section 8; thence, 1. Southwesterly along a line bearing S 23026'58" W 334.25 feet; thence, 2. Continuing southwesterly along a line bearing S 15036104" w. to a point, said point being In the north line of the south 248.38 feet of the west 404.85 feet of the north 15 acres of the swt of the NWt of said Section 8, said point also being in the north line of that parcel of land conveyed by deed No. 25129 and recorded June 14, 1947, to Otto Oomrles and Johanna Domrles; thence, 3. Easterly and so~therly along the north and east line of the last mentioned parcel of land to a point, said point being in the south line of said north 15 acres of the swt of the NWt of said Section 8, said point also being the southeast corner of said last mentioned parcel of land; thence, 4. Westerly along the last mentioned south line and Its westerly pro- longation to a point, said point being 30 feet west of the east line of said Section 7; thence, 5. Northerly along a line parallel w:th and 30 feet westerly of said east line of Section 7 to a point in the north line of the south half of NE! of said Section 7; thence, 6. Westerly along the north line of said st of NEt of said Section 7 .".-..._ to the east line of Tract No. 1202 as said tract is shown on a map filed in Book 37, Pages 27 and 28 of Miscellaneous Haps In the office of the County Re~order of said Orange County, California; thence, 7. Northerly along the east line of said Tract No. 1202 to Its point of Intersection with the said southwesterly right-of-way of the Southern -2- - Pacific railroad, said point also being In the existing City limits line as established by the aforementioned Gilbert Street Annexation to the City of Anaheim; thence, 8. Southeasterly along the existing City limit lines and said Southern Pacific railroad right-of-way line to the point of beginning. -, -)- - - '. NOW, THEREFORE, BE rr RESOLVED BY TFE CITY COUNCIL OF THE CITY OF ANAHEIM: .-... AND BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not filed their consent to such annexation, in writing, with the City Council. AND BE IT FURTHER RESOLVED that the 25th day of November , 19..2L, at the hour of 7:00 0' clock ....l.LM., at the City Council Chambers in the City Hall of the City of Anaheim be, and the same :1s hereby, fixed as the day, hour and plaoe when and where the City Council will hear protests made by any owner or owners of real property within the territory pro- posed to be annexed; and that at any time before the hour set for hearing objections, any owner of property within said territory may file with the City Clerk a written protest against the an- nexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit: tae Anaheim Gazette of Anaheim, Orange County, California, and also in a newspaper of general circulation, publiShed outside of the City, but in the County or Orange,. in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: The Dai 1)1" },Jews of Ga!'den Gf.Ollve ,Orange County, California; and that such publication shall be completed at least twenty (20) days prior to the date or hearing hereinabove specified. ,- AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be an- nexed is assessed, in the last equalized county assessment roll available, on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, ei ti1er legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of -L~-. - - Anaheim shall also oause written notioe of suoh proposed annexa- tion to be mailed to the Board of Superv1sors of suoh Oounty. The foregoing notioes shall be given not less than twenty (20) days before the first pUblic hearing on the proposed annexat1on.
