RESOLUTION NO. 4758

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING VARIANCE NO. 1009.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition for zoning variance from
Murray Walker, purchaser, under contract, of the following
described real property situated in the City of Anaheim,
County of Orange, State of California, to wit:
PARCEL 1: The West 194.00 feet of the following
described parcel of land:
The North 10 acres of the South 20 acres of the
Southwest quarter of the Northwest quarter of Section
21, Township 4 South, Range 10 West, S.B.B.&M.
EXCEPTING the North 100.00 feet.
ALSO EXCEPTING therefrom the following: Beginning
at a point on the Westerly line of the Northwest
quarter of said Section 21, distant North 561.22 feet
from the Southwest corner of the Northwest quarter of
said Section 21; thence North 89058'00" East 194.00
feet; thence South 60.00 feet; thence South 89058'00"
West 126.01 feet to the beginning of a tangent curve
concave Southeasterly having a radius of 15.00 feet;
thence Westerly, Southwesterly and Southerly along said
curve through a central angle of 89058'00" a distance of
23.55 feet; thence West 53.00 feet to the Westerly line
of the Northwest quarter of said Section 21; thence
North 74.96 feet to the point of beginning.

rARCEL 2: That portion of the Southwest quarter of the
Northwest quarter of Section 21, Township 4 south, Range
10 West, S.B.B.&M., described as follows:
Commencing at the intersection of the Westerly line
of the Northwest quarter of said Section 21 with the
Westerly prolongation of the Northerly line of Tract No.
1322, as shown on a map recorded in Book 40, Page 7 of
Miscellaneous Maps, records of Orange County, California,
said point being distant North 331.70 feet from the South-
west corner of the Northwest quarter of said Section 21;
thence North 890 58' 00" East along said Westerly prolonga-
tion a distance of 266.25 feet, said point being the true
point of beginning; thence North 0001'34" East 163.92 feet
to the beginn~ng of a non-tangent curve concave Southwesterly
having a radius of 395.00 feet, a radial line through said
point bears North 9037'48" East; thence Southeasterly along
said curve through a central angle of 6055'08" a distance of
47.70 feet to the beginning of a tangent curve concave North-
easterly having a radius of 455.00 feet; thence Southeasterly
along said curve through a central angle of 3021'59" a
distance of 26.73 feet; thence South 0001'34" West 146.22
feet to the Westerly prolongation of the Northerly line of
said Tract No. 1322; thence South 89058100" West 72.26 feet
to the true point of beginning.
PARCEL 3: That portion of the Southwest quarter of the
Northwest quarter of Section 21, Township 4 South,

Commencing at the intersection of the Westerly line
of the Northwest quarter of said Section 21 with the
Westerly prolongation of the Northerly line of Tract No.
1322, as shown on a map recorded in Book 40, Page 7 of
Miscellaneous Maps, records of Orange County, California,
said point being distant North 331.70 feet from the South-
west corner of the Northwest quarter of said Section 21;
thence North 89058100" East along said Westerly prolonga-
tion a distance of 194.00 feet, said point being the true
point of beginning; thence North 169.52 feet; thence North
89058100" East 6.02 feet to the beginning of a tangent
curve concave Southwesterly having a radius of 395.00 feet;
thence Easterly along said curve through a central angle of
9039'48" a distance of 66.62 feet; thence South 0001'34"
West 163.92 feet to the Westerly prolongation of the North-
erly line of said Tract No. 1322; thence South 89058'00"
West 72.25 feet to the true point of beginning.
A~D ~~REAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on July 21, 1958, notices of which said public hearing
were duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
Wh~REAS, said Commission, after due inspection, investi-
gation and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. 25, recommending to the City Council
of the City of Anaheim that Variance No. 1009 be granted upon the
conditions stated in said resolution; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pro-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not ad-
versely afEect the comprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to MURRAY WALKER, 774 Louis Street, Long
Beach, California, to construct and operate a rest home on the

property hereinabove described, subject to the following
conditions:
1. That all engineering requirements of the City
of Anaheim along Euclid Avenue, such as curbs
and gutters, sidewalks, street grading and
paving, drainage facilities or other pertinent
work, be complied with as required by the City
Engineer, in accordance with plans and speCifica-
tions on file in the Office of said City Engineer.
2. That the owner of subject property deed to the
City of Anaheim a strip of land 53 feet in width,
from the center line of the street, along Euclid
Avenue for street widening purposes.
3. That the owner of subject property pay to the
City of Anaheim the sum of $2.00 per front foot
for street lights on Euclid Avenue.
4. That subject property be developed in conformity
with the plans submitted to the City Council and
on file with the City of Anaheim.
5. That a 6-foot masonry wall be constructed along
the South and East property lines.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner or
his heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOIlIIG HESOLUTION is signed and approved by me
this 16th day of September, 1958.
