57R-4146 - RESOLUTION NO. 4146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 798). _r-- Anaheim, WHEREAS, the City Planning Commission of the City of Ana- reoeive a petition from the property owner 1!)1!!l!kf _ of certain real property situate~n the City of Oounty of Orange, State of California, described as follows: The West 100 feet of the East 248 feet of the North 260 feet of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 13, in Township 4 South, Range 11 West, Rancho Los Coyotes, as said Section is shown on a maP thereof recorded in Book 51, page 11, Hiscellaneous IjiHps, records of Orange County, California. heim did ~~CEPTING THEREFROh the North 160 feet of the East 50 feet. AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on August 5, 1957 , notices of which said publio hearings were duly given as required by law and the provisions of Bection 9200.17 of the Anaheim Municipal Codej and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 28 ,recommending to the City Coun- cil of the City of Anaheim that Variance No. 718 be granted upon the conditions stated in said resolutionl an WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. ~ 3. T~t the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Oouncil of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to HORACE T. GRAIN, 929 South Van Ness, 3e.ntE,. Ana, California, to use the ~oroperty hereinabove described for the construction and. operEltion of an Auto Electric Repair and -1- ~- - Tune-up Shop, E'Dcl stock the reqlJ.ire( 8mount of supplies, sUbject to the following conditions: ~ 1. That no care, which are to be repaired, shall be parked between Lincoln Avenue and the proposed builcUng. 2. That there be a 28-foot building set-back from the property line on Lincoln Avenue. 3. That Beid building shall be constructed in accordance with revised plans submitted to the Oity Oouncil and on file with the Oity of Anaheim. 4. That complete plans of the proposed building shall be furnished to the Building Department of the Oity of Anaheim before a permit is issue~. ^~ The Oity Council hereby reserves the right to revoke such varianoe permit for good cause or failure of said owner or their heirs, aucces.ors or assigns, to comply with the Anahei~unicipal Code and regulations and the conditions herein.
