57R-4143 ~ RESOLUTION NO. 414'3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 821). ~ ~... WHEREAS, the City Planning Commission of the City of Ana- heim did receive a petition from the property owner --......~ of certain real property situated in the City of Anaheim, County of Orange, state of California, described as follows: Lot 26, Block 3 of Tract 419, as shown on a map recorded in Book 16, Page 2, of Miscellaneous Maps, records of Orange County. (Said property is located at 12822 Midway Drive, Anaheim, California). AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the City of Anaheim upon said peti- tion on Septfmber 1. 19S7 , notices of which said public hearings were du y given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. SO ,recommending to the City Coun- cil of the Oity of Anaheim that Variance No. 821 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. --- 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to G, E. EARP, 1422 East Willow Street, Ane.heim, Ca.lifornia, to erect 8. 2-story building, with four l-bedroom -1- '1 apartments--two up and two do"rn--seic1 build_ing to be erected on the property hereinabove described, bel:'incl the existing l-bedroom house, subject to the follm..ing conCi.itions: - 1. That the building to be erected on subject property be constructed in accordance with revised plans sub- mitted to the City Council and on file with the City of An&heim, which plans provide that the building be so situated to allow for four parking spaces, and the required setbacks. 2. That there be a minimum space of 10 feet between the building to be constructed and the existing structure. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner or their heirs, successors or assigns, to comply with the Anahei~unicipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
