RESOLUTION NO. 4119
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 819)

WHEREAS, the City Planning Oommission of the City of Ana-
heim did receive a petition from the property owner and/or
authorized agent of certain real property situated in the City of
Anaheim, Oounty of Orange, State of California, described as follows:
That portion of the 11est half of the Northeast quarter of
the Northeast quarter of Section 17, Township 4 South, Range
10 West, S.B.B. & M., in the county ef Orange, state of
California, described as follows:
Beginning at a point on the North line of said West half,
distant thereon Easterly 315 feet frQm the Northwest corner
of said i'iest half and running thence Southerly parallel with
the West line of said West half, 693.0 feet; thence East
parallel with the North line of said West half to the East
line of said :iest half; thence North along said East line to
the North line of said West half; thence West along said North
line to the point of beginning.
EXCEPT the West 125 feet of the North 300 feet thereof.
AND WHEREAS, the City Planning Commission did hold a pub-
lic hearing at the Oity Hall in the City of Anaheim upon said peti-
tion on September 3, 1957 , notices of which said public
hearings were duly given as required by law and the provisions of
Section 9200.17 of the Anaheim Municipal Codel and
WHEREAS, said Commission, after due inspection, investiga-
tion and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. 48 ,recommending to the City Coun-
cil of the City of Anaheim that Variance No. 819 be granted upon
the conditions stated in said resolution; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

J. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Counoil,of the
City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to GOLF ASSOCIATES, INO., to erect and operate
a Motel on the above described Droperty, sub ject to the follo\iring
conditions:

1. That the buildings to be erected on subject property
shall be substantially the same as shown on the plans
presented to the City Council and on file with the
City of Anaheim.
2. That the minimum building setback requirement shall be
91 feet from the present centerline of Lincoln Avenue.
3. That all engineering requirements of the City of
Anaheim, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities or other
pertinent work be complied with as required by the
City Engineer.
The City Council hereby reserves the right to revoke such
variance permit for good cause or failure of said owner~~M~.~--~M
l~'~~a successors or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
