RESOLUTION NO. 67R-40
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 66-67-22 to consider an amendment to
Title 18 of the Anaheim Municipal Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the pro-
posed amendment be adopted by the City Council and that a
certain zone o~ zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, repo~t of findings and recommendation of the City
Planning CQmmission the City Council did fix the 17th day
of January.. , 19 67 as the time, and the City Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said
property, hereinafter described, from the zone or zones in
which it is now situated and the incorporation thereof in the
zone or zones ~ereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the ti~e ~nd place fixed for said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therei* an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon ~onsider the s~ary of evidence presented at
said public hearing before the Pl~nning Commission, its report
of findings and recommendatiQn; and
WHEREAS. the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafte~ d~scribed
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as ~ereinafter
set forth.
NOW. THEREFORE. BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County
of Orange, State of California. to wit:

Parcel No.1:
That portion of the Southeast one-quarter of Section 26,
Township 4 South, Range 10 West, in the city of Anaheim,
as said section is shown on a map thereof recorded in
Book 51, Page 10, Miscellaneous Maps, records of said
Orange County, described as follows:
Beginning at a point in the West line of the said South-
east one-quarter said point being the Southwest corner
of the land covered by Certificate of Titles No. 14,138,
filed in the Office of the Registrar of Titles of said
Orange County; thence North 710 3D' DOli East 253.00 feet
along the Southerly line of said land covered by Certifi-
cate of Titles No. 14,138 to the Southeasterly corner
thereof; thence South 400 38' 201l East 3.10 feet; thence
North 710 37' 451i East 220.99 feet; thence South 180 22'
15" East 772.70 feet; thence South 710 09' 57" West
714.45 feet to the West line of said Southeast one-quarter
and the Southwest corner of the land covered by said
Certificate of 'ritles No. 6495; thence North 10 20' 00"
West along said West line and along the West line of the
land covered by said Certificate of Titles No. 6495, a
d.istance of 816.61 feet to the point of beginning.

That portion of the Southeast one-quarter of Section 26,
Township 4 South, Range 10 West, in the City of Anaheim,
as said section is shown on a map thereof recorded in Book
51, Page 10, Miscellaneous Maps, records of said Orange
County, described as follows~
Beginning at a point in the West line of the said South-
east one-quarter said point being the Southwest corner of
the land covered by Certificate of Titles No. 14,138, filed
in the Office of the Registrar of Titles of said Orange
County; thence North 710 30' 00" East 253.00 feet along the
Southerly line of said land covered by Certificate of
Titles No. 14,138 to the Southeasterly corner thereof;
thence South 400 38' 201: East 3.10 feet; thence North 710
37' 45" East 220.99 feet to the true point of beginning;
thence continuing North 710 37' 45" East 865.00 feet to a
point in the Easterly line of that certain parcel of land
conveyed to Melrose Abbey, Inc. by deed recorded August 23,
1954, in Book 2798, Page 249, Official Records, said point
being on a curve concave Southwesterly and having a radius
of 2458.00 feet, a radial line at said point bears North
580 45' 3111 East; thence along the Northeasterly and South-
easterly line of said land the following courses and dis-
tances; Southeasterly along said curve through a central
angle of 50 09' 0111 an arc distance of 220.95 feet; South
260 OS' 2811 East tangent to said curve 248.98 feet, to the
beginning of a tangent curve concave Northeasterly and
naving a radius of 2042.00 feet; Southeasterly along said
curve through a central angle of 30 41' 28 II an arc distance
of 131.55 feet; South 490 II' 0711 West 282.24 feet; South
400 48' 53" East 76.64 feet to the Southeasterly line of
land covered by last mentioned Certificate; South 710 38'
1211 V'lest 54.10 feet to the Southwesterly line of the land

South 710 381 12" Hest along the Southeasterly line of
the land covered by said Certificate of Titles No. 6495,
a distance of 617.44 feet to Station No. 73 of the Rancho
Santiago de Santa Ana; thence South 710 091 5711 West
56.63 feet; thence North 180 221 1511 West 772.70 feet to
the true point of beginning.
now is R-A, AGRICULTURAL ZONE, and that it be changed to the
following zones, upon the conditions hereinafter set forth:
That Parcel No. 1 above described shall De changed to
and incorporated in R-3, MULTIPLE-FM1ILY l~SIDENTIAL
ZONE; and
That Parcel No. 2 above described shall be changed to
and incorporated in C-l, GENERAL CO~WlliRCIAL ZONE.
That said change of zones shall be made upon the following
conditions:
1. That the owners of subject property shall deed to
the City of Anaheim a strip of land -thirty-five
(35) feet in width, from the center line of the
street, along Lewis Street, for street widening
purposes.
2. (a) That all engineering requirements of the City
of Anaheim along Lewis Street and Manchester Avenue,
including preparation of improvement plans and in-
stallation of all improvements, such as curbs and
gutters, sidewalks, street grading and paving,
drainage facilities, or other appurtenant work shall
be complied with as required by the City Engineer
and in accordance with standard plans and specifica-
tions on file in the Office of the City Engineer;
and (b) that a bond in an amount ana fonn satisfactory
to the City of Anaheim shall be posted with the City
to guarantee the installation of said engineering re-
quirements.
3. That the owners of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot,
along Lewis Street and Manchester Avenue, for street
lighting purposes.
4. That the owners of subject property shall pay to the
City of Anaheim the sum of 159 per front foot along
Lewis Street and Manchester Avenue, for tree planting
purposes.
5. That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of the
Director of Public Works and Superintendent of Streets,
prior to final building and zoning inspections.
6. That fire hydrants shall be installed as required and
determined to be necessary by the Chief of the Fire
Department, said fire hydrants to be installed prior
to final building and zoning inspections.
7. That the owners of subject property shall pay to the
City of Anaheim the sum of $25.00 per dwelling unit,

to be used for park and recreation purposes, said
illuount to be paid at the time the building permit
is issued.
8. That all air conditioning facilities for the com-
mercial portion of subj~ct property shall be properly
shielded from view and all ?ounds buffered from
adjacent residential developments, prior to final
building and zoning inspections.
9. That Conditions Nos. 1, 2(b), 3 and 4 above-mentioned
shall be complied with within a period of 180 days
from date hereof, or such further time as the City
Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to the
City Council an ordinance amending Title 18 of the Anaheim
Hunicipal Code to accomplish the objects herein found and deter-
mined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 17th day of January, 1967.
