1967-029 RESOLUTION NO. ~7R-29 ~F ~~~{~O~cgipi~G CIJYE;:2:;~t~~ gI~~I~;ifI CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR AN EASEMENT FOR PUBLIC UTII,.ITY DRAINAGE PURPOSES. WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit~ An easement for public utility drainage purposes and . , WHEREAS, the owner of said property ha~ offered to sell and convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of ORANGETHORPE INDUSTRIAL PARK to sell to the City of Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for an easement for public utility drainaqe purposes , and more particularly described as follows: An easement for public utility drainage purposes over, under and across those parcels of land described as follows~ The westerly 15.00 feet of lots 10, 11, 12, 13 and 16 of Tract No. 4703, as shown on a Map recorded in Book 169, pages 25 and 26 of l-liscellaneous Haps, records of Orange County, California. Said easement is granted upon the following expressed conditions: 1. The property owner retains the right to use the land for any and all purposes incident to the use of the adjoin- ing property insofar as these uses do not conflict with the purpose or the maintenance of the easement. No permanent buildings or structures are permitted. 2. The property owner retains the right to cross Sa1Q easement with rail or other types of service and access, so long as said servic~ and access does not conflict with the purpose of the easement and is constructed in accordance with plans approved by the City Engineer. 3. The property owner retains the right to construct fences across the easement, so long as said fences do not conflict with the purpose of the easement and are constructed with adequate gates and availability for maintenance purposes and in a manner acceptable to the City Engineer. -1- be, and the same is hereby, accepted by the City Council of the City of Anaheim, and that the City of Anaheim accept a convey- ance of said property. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owner or owners of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
