1967-013 RESOLUTION NO. 67R- 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ~~AHEIM ORDERING THE VACATION AND ABANDONMENT OF THAT PORTION OF AN EASEMENT FOR ROAD &~D PUBLIC UTILITY PURPOSES UPON, OVER, ACROSS, ALONG AND THROUGH THE HEREINAFTER DESCRIBED REAL PROPERTY. WHEREAS, the City Council of the City of Anaheim, a rvlunicipal Corporation of the State of California, did on the 20th day of December, 1966, pass its Resolution No. 66R-789 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIH DECLARING ITS INTENTION TO VACATE AND ABANDON THAT PORTION OF AN EASEMENT FOR ROAD &~D PUBLIC UTILITY PURPOSES UPON, OVER, ACROSS, ALONG AND THROUGH THE HEREINAFTER DESCRIBED REAL PROPERTY; FIXING A TIME Al~D PLACE FOR A HEARING THEREON; DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS RESOLUTION," whereby it declared its intention to vacate and abandon and close to public use that portion of an easement .for road and public utility purposes upon, over, across, along and through the hereinafter described property, under the pro- visions of the Street Vacation Act of 1941, and under the pro- visions of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5 of the Government Code; and WHEREAS, the City Council in said resolution referred to a map on file in the Office of the City Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said portion of easement for road and public utility purposes; and WHEREAS, said City Council did by said resolution fix the lOth day of January, 1967, at 1:30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim as the time and place for a public hearing on the matter of such vaca- tion, abandonment and closing to public use of said portion of easement for road and public utility purposes, for all persons interested in or objecting to such proposed vacation, abandon- ment and closing to public use to appear and show cause, if any they had, why such portion of easement for road and public utility purposes should not be vacated, abandoned and closed to public use; and WHEREAS, said resolution was published on the 29th day of Decenilier, 1966, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, Orange County, California; and WHEREAS, by said resolution said City Council directed that notices of the passage of said resolution and of the time and place of the hearing on the matter of the vacation, abandon- ment and closing to public use of said portion of easement for road and public utility purposes be posted conspicuously along the line of said portion of easement, not more than 300 feet apart, at least ten (10) days before said hearing, and that not less than three (3) such notices should be posted; and WHEREAS, Donald R. O'Donnell did on the 29th day of December, 1966, post conspicuously not less than three (3) such notices along the line of said portion of easement, which -1- notices were posted not more than 300 feet apart, and were posted at least ten (10) days before said hearing; and WHEREAS, said city Council did on the 10th day of January, 1967, at 1:30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim, conduct a public hearing on the matter of whether said portion of easement for road and public utility purposes, hereinafter described should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon; and . WHEREAS, the City council finds from all of the eV1dence submitted that said portion of easement for road and public util- ity purposes described in the Resolution of Intention and herein- after described, is unnecessary for present or prospective road and public utility purposes, and that an order vacating and aban- doning such portion of easement for road and public utility purposes as described in the Resolution of Intention should be made. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds the recitals hereinabove set forth in this resolution to be true; 2. That it finds from all the evidence submitted that said portion of easement for road and public utility pur- poses described in said resolution is unnecessary for present or prospective public purposes; 3. That it does hereby order that said portion of easement for road and public utility purposes be, and it is hereby, vacated, abandoned and closed to public use; 4. That said portion of easement herein ordered vacated, abandoned and closed to public use is that certain portion of easement described in said Resolution No. 66R-789, is situated in the City of Anaheim, County of Orange, state of California, and is more particularly described as follows: That portion of an existing road and public utility easement conveyed to the city of Anaheim by deed recorded December 30, 1964 in Book 7365, page 156 of Official Records of Orange County, California, described as follows: Commencing at the center line intersection of Crescent Avenue and Gilbert street, for the purpose of this de- cription, the center line intersection of said streets also being the northeast corner of the Southwest quarter of Section 7, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of said Orange County, California; thence South 880 55' 35" West 1320.86 feet along a portion of the North line of said Section 7, to an intersection with the Northerly prolongation of the Easterly line of Tract 2451, as shown on a Hap recorded in Book 189, pages 36 and 37 of Miscellaneous Haps, records of said Orange County, California; thence South 00 21' 45" East 45.00 feet along said prolongation and a portion -2- of the Easterly line of said Tract No. 2451 to an intersection with a line parallel with and 45.00 feet Southerly of the center line of said Crescent Avenue, said point of intersection being the true point of beginning of the hereinafter described parcel of l~nd; thence South 00 21' 45" East along a portion of the East line of Tract 2451 a distance of 619.18 feet; thence North 880 56' 05" East 320.90 feet to the beginning of a curve concave Southeasterly and having a radius of 1,239.50 feet, a radial line bearing North 140 40' 59" West passes through the point of beginning of said curve; thence Northeasterly along said curve through a central angle of 130 36' 10" an arc distance of 294.27 feet; thence North 880 55' 1111 East 677.06 feet tangent to said curve to an inter- section with a line parallel with and 32.00 feet westerly of the center line of said Gilbert street; thence North 00 22' 4511 West 69.93 feet along said parallel line to a point, said point being the beginning of a curve concave Northwesterly and having a radius of 15 feet, a radial line bearing North 8Bo 55' 1111 East passes through the point of beginning of said curve; thence Southerly and westerly along said curve through a central angle of 890 17' 56" an arc distance of 23.39 feet; thence South 880 55' II" West tangent to the last mentioned curve a distance of 662.92 feet to the beginning of a tangent curve concave Southeasterly and having a r~dius of 1295.00 feet; thence South- westerly along said curve through a central angle of 90 20' 1711 an arc distance of 211.06 feet; thence South 790 34' 5411 ~vest 50.00 feet tangent to said curve to the beginning of a tangent curve concave North- westerly and h~ving a radius of 715.00 feet; thence Southwesterly along said curve through a central angle of 90 21' 1111 an arc distance of 116.72 feet; thence South 880 56' 0511 West 165.37 feet tangent to the last mentioned curve to the beginning of a tangent curve concave Northeasterly and having a radius of 15 feet; thence westerly and Northerly along said curve through a central angle of 900 42' 1011 an arc distance of 23.75 feet to an intersction with a line parallel with and 55.5 feet Easterly of the East line of the aforementioned Tract 2451; thence North 00 21' 4511 West 533.69 feet tangent to the last mentioned curve along said parallel line to the beginning of a tangent curve concave Southeasterly and h~ving a radius of 15 feet; thence Northerly and Easterly along said curve through a central angle of 890 17' 20" an arc distance of 23.38 feet to an intersection with a line parallel with and 45.00 feet Southerly of the center line of the aforementioned Crescent Avenue; thence south 880 55' 35" West 69.78 feet along the last mentioned parallel line to the true point of beginning.
